Hi
I would like to file for canada immigration. However, I have a pending divorce case which is expected 2 be over in three months. In which category should I apply..Married, divorced or legally separated
Secondly I have the sole legal custody of my daughter. Will it create problems in immigration if my wife has visiting rights on weekends. I have been advised I dont need any consent. Any one who can confirm the same?

My 2 Cents worth: (This is just my opinion and is not to be taken as a legal advise)
If I were you, I would wait till the divorce case is through before I apply. This will enable you to prove that you are divorced, hence Divorced.

Secondly, though you have the sole legal custody, your wife might be adamant in exercising her visiting right, hence in my view you may need a NOC - No objection consent from her,

CHILDREN’S INFORMATION (IF APPLICABLE)

• Children’s birth certificates (which name their parents)
• Adoption papers for adopted dependent children
• Proof of custody for children under the age of 18 and proof that the children may
be removed from the jurisdiction of the court
• If the children will not accompany you to Canada, proof that you have fulfilled any
obligation stated in custody agreements
