My wife and I recently got married. We have a daughter that was born a month ago.
I am currently visiting them but have all the forms filled out for inland spousal sponsorship with an open work permit.
We don't want me to have to leave the family again as it was hard being away I even missed the birth of my Daughter.
My visitor Visa is supposed to end in 7 days but I know if I send my application before then I am under implied status.
We are still waiting on the birth certificate and marriage certificate and police certificate. I have included explanations that we are waiting for the documents and will send them as soon as we receive them.
Bottom line is we don't want our family to be split up again. Will they accept this?

Another question I have applied for the open work permit but it has fields for employer info and address? What do I put there if I haven't got one yet? I was planning on job hunting once I am approved.

Unfortunately, they will not accept letters saying you are waiting for the certificates. You must submit copies of the certificates.

You do not need to fill in employer's details in the OWP application.

I just got through to the Immigration number and they said I can send the explanation that I'm still waiting and can send it as soon as we receive it.

And you do not get implied status by sending in the spousal sponsorship application. But it's from the OWP application.
It doesn't look like you can submit a complete application before your visitor status expires. So try to file an extension of your visitor status. You will need a valid status to get the OWP in roughly 4 months from the day you apply (with complete application package).
Try not to become out of status.

I meant the implied status was from the OWP.
I am a bit confused as the IRCC just told me I can send the application and as long as I have informed them that we are still waiting for the paperwork it will be fine.
She even sent me a link I can use when we receive the paperwork.

The Call Centre staff are poorly trained and cannot answer basic questions. If you send your app missing all of that, it will be returned as incomplete, particularly without the marriage certificate.

Apply now to extend your stay as a visitor and submit the PR app when you actually have the necessary documents.

I would strongly recommend against sending the application without the required documents. Based on experiences here, you should expect the application to be returned as incomplete.

Alright thank you,

I have applied to extend my stay and wrote a letter with it saying that we are waiting for documents to apply for spousal sponsorship and asking for compassion so that I can stay with my wife and daughter.

New questions though. The fees I payed for the spousal sponsorship and open work permit, will that receipt still be valid when we send it in at a later date?
