Hi. My husband and I were married in August 2013 in Quebec (I went there on single entry TRV & get married there). I returned to Malaysia and currently is staying in Malaysia while my husband is still in Quebec but planing to move to ALberta very soon. We submitted out spouse visa application but was returned due to incomplete information (he has not receive the parcel yet so we have no idea what was missing). We were given a client number instead of the IME number.
My husband had just completed his degree and currently unemployed. He plans to pursue his post degree (one year program) very soon in Alberta.
My questions are:

1. Would his plan to pursue his study affect the application as sponsor?
2. Do I still have a good chance to apply for multiple entry TRV since we have submitted our application (although returned and given only client number?). If yes, can I use the purpose of going as "visiting husband"? Does it mean that we need to apply for TRV BEFORE we re-submit for the spouse visa?
3. It will be a long wait, so is there is any way to get there eg via study visa or work permit while waiting for the PR to be approved?

Really appreciate your help. Staying apart is hard :(

I can't fully help you with all the questions, so hopefully someone will chime in on the last one..

1. His plan to study should not affect his ability to sponsor. So long as he's not collecting welfare, he is eligible to sponsor. Sponsors do NOT need to meet the minimum income requirements :)
Just be sure he's including enough proof that he's financially stable.. such as t4s, bank statements, or the Option-C printout.

2. I can't really say for sure, but I know it's usually quite difficult for spouses to get a TRV since they expect that they won't return. Especially if you've already submitted the residency application. My husband's TRV was rejected BECAUSE he's my husband ("strong family ties to Canada")

As for the third question, I can't help you much!

I'm wondering about the Quebec/Alberta thing.. the application through Quebec is different than the application for the the rest of Canada. Is he applying as a Quebec resident (stating that you will be living in Quebec), or as an Albertan resident? Again, I don't know too much about this so hopefully someone else can help!

You could try to get another TRV. You might have a good chance of getting accepted because you had one before and left when you were supposed to, even after you were married to a Canadian. That will really work in your favor.

You could try for a study visa or a work visa, I'm not sure how either of those types of visas work though, or what the requirements are. I do know that because you applied outland if you need to get an interview you will have to go back to your home country to have it done, and when they request your passport you will need to send it to your Visa Office in whichever country that may be. So this might not work so well for a study visa because of having to leave for the interview, you wouldn't be able to control when they decide they want you to have it...I mean I think you can choose the date but there's always time restrictions so if they send you a letter at the end of november and you have 30 days to go get your interview done then you could be missing finals and stuff.

The chances of getting another type of visa while waiting for your Permanent Residence status is very low.... but you can always try, just be aware of the most likely outcome...... yes, the waiting is long... you know it.. maybe the best thing for you to do was stay in Canada once you got married... as spouse you could get a working permit while waiting for you application for PR., but too late now..... Now enjoy your country .... Canada can get cold
