My boyfriend (Canadian residing in Canada) and I (Malaysian residing in M'sia) are planning to get married next year. We have met a few times and been dating for more than a year (LDR). We love each other and would like to live together as husband and wife eventually, and it would be in Canada. However, at this moment both of us are too busy with our studies (mine post graduate, his degree). What is the best options for our wedding/marriage arrangement and also my spouse visa application? One option we could think of (to get married in M'sia is not possible as he does not have the time to fulfill the time requirement for registration of our marriage in M'sia):

I come as visitor to Canada and get married, go back to M'sia (as I still have to complete my study) and meanwhile proceed for the spouse visa application. In this case, what reason should I give when I apply for a visit visa? Do I need to prove that I am definitely going back to M'sia after our marriage? (I can't even stay for more than 3 weeks due to my present job & study). Will affect my spouse visa application if we did it this way?

Any other better options?

Your feedback is most appreciated.

To obtain a TRV you would need to demonstrate your visit is temporary in nature. For example, you indicate you must return to your job - this is actually good, as it demonstrates you will not overstay in Canada. Showing strong ties to your home country, family ties, financial resources to support yourself while visiting Canada, etc. are all important factors in obtaining a TRV.

So, saying that you are coming to visit your bf in Canada is perfectly reasonable, particularly when combined with strong evidence you fully expect to return to Malaysia when your visit is over.

Once in Canada, you can get married. Once married, he can initiate the sponsored spousal application. Approval for him as sponsor is currently 2.5 months. Then your application would be forwarded to Singapore, where the current processing time is 16 months for 50% of applications and 25 months for 80%, so you will have plenty of time to complete your studies.

There is nothing wrong with doing it this way. You should be prepared to demonstrate that your relationship is genuine, so logs of your communication (evidence of telephone calls, chat logs, e-mails, etc.), pictures of your wedding, etc.

Good luck!

Thank you Computergeek. Will a return ticket be a good proof for my return to M'sia? :P Anyway, it won't be a problem to proof that (letter of employment, etc).

Say, if my PR application is approved much earlier than expected before the completion of my study, do I need to move to Canada right away or can I wait?

Thanks

The legal obligation is that you must spend 730 days in Canada within the first 5 years of permanent residency, so while you may need to come to Canada within a couple of months of receiving your COPR and visa, once you do so, you can return to Malaysia and wrap things up there - just don't wait longer than 3 years to move to Canada permanently.

Good luck!
