Hi there,

I've been looking through this forum but I couldn't find a case like mine. Hopefully you guys can help me.
I immigrated to Canada with my family in 1999. Lived in Canada from 1999 to 2003, but after that period I never went to Canada again. In 2015, I applied for a Travel Document, but was denied and as a final determination I lost my permanent residency status. This year, 2018, I applied for an eTa and I got it approved. Which means I clearly lose my permanent status otherwise I wouldn't be able to get an eTa. When I arrived in Canada I went to Service Canada to check my Sin Number (I didn't have the number with me anymore). See, by the time I left Canada in 2003 there was no PR card, we only had the Landing Record. So, I showed my Landing for them and they told me my SIN was dormant, but only needed to be reactivate and I'll be fine. I filled a form explaining why I was away and they gave me 6 weeks to receive my SIN letter at the address I gave them. After 8 weeks I received the SIN letter and apparently everything is fine with that. Me and my wife were preparing to apply for an Express Entry. However, we have some concerns now:
1. Will the activation of the SIN interfere on our Express Entry application?
2. As I have lost my permanent status, shouldn't the Service Canada system alert that I've lost my status and "block" my SIN or at least inform me that I wouldn't be able to reactivate my SIN until I have a permanent resident status again?
3. If I lost my status technically I'm not allowed to work in Canada I'm only a visitor. If I use my SIN to work and pay taxes, can I ask for a PR card after meeting the residency obligation of 730 days? Or I'll be crazily infringing the law working illegally with my old legal document and it won't matter how many days I stayed in Canada I would never get the PR card unless I re-do the whole process since the beginning? I only have this question because I received the SIN Letter and because I really wanna go under the radar about it until I figure out what to do, and also because I don't wanna screwed the Express Entry out finding that I wasn't suppose to apply for it.

If your PR was revoked, then you cannot use your current SIN. You must notify Service Canada and return the SIN. Using the SIN with no legal status is illegal.
 
  1. No it won't
  2. Your SIN number is for life. If you apply through EE, the SIN number remains the same.
  3. You can't work, you are a visitor. Your permanent residency is lost and there is no way to renew your previous status. You will have to apply again.

By showing your Landing document to Service Canada, you effectively misrepresented your immigration status. Did you declare on the reactivation form that you are now only a "foreign national" and that your Landing document is no longer valid?

If you use your SIN to work, you'll be working illegally. Plain and simple.

Your PR status is long gone. You need to apply for PR from scratch through Express Entry or another immigration stream.

I agree.

You showed them your landing paper that is invalid (since your PR has been revoked). And I am sure that you lie to them when you explained the situation by NOT telling them that your PR was already been revoked. (Not telling the whole truth is lying.)

You cannot use this SIN card and cannot work. Until your Express Entry PR application has been approved and you have landed, then you will likely get the same SIN number. By then, you can use your SIN card.
