Hi there,

I am wondering on what visa should I file for. My wife is a PR and got her PR card before we got married, but she is currently with me in India and haven't yet moved to Canada. As we both want to stay together I am planning to apply for a Study permit and move with her and then later apply for a spousal sponsorship, am not sure if they will refuse my visa because she is a PR, looking for advice. I do have the required funds and college acceptance in place. It would be really helpful if someone could help on this.

It's impossible for us to say. The study permit may be refused or it may be approved. To have a high chance of refusal, you will need to show the education you plan to take in Canada makes sense in light of your previous education and work experience. You will also need to demonstrate you have strong ties to your home country and have no plans on remaining in Canada long term.
 
The fact that your wife is PR has little impact, providing your student visa is supported by all the documents and funds they need. Providing strong home country tie also helps for a student visa approval.

I forgot exactly, but if you are requested in the forms, you do have to declare your spouse is PR of Canada or else it's misrepresentation.

btw, isn't inland spousal PR now takes >5 years?
