Hey Guys,

I have got a question, i was hopping if any of you might have the answer to it.
Would a person be eligible for LMIA exemption while holding open work permit and 1+ work experience in canada.

If you're talking about the 50/200 points one could get for having a valid job offer then no, you do not qualify.
 
But according to the exemption code list the graduate student holding PGWP are exempt from LMIA

But to qualify for the additional points you have to either have an lmia or a closed work permit such as a NAFTA or ICT. A PGWP does not qualify.
 
Correct, a PGWP is an open work permit thus, it does not qualify.

Base on the telephonic conversation i had with cic,
They told me i could check the section in the check list for the job offer while i have exemption, and i could the 50 points

Then go for it, claim those 50 points an await rejection.

I suggest for you not to claim those points are you're not entitled to them.

You do not have a LMIA exempt work permit which is employer specific.

Considering 75% of draws have been below 500, probably very high.

Make sure you have not claimed the 50 points for valid job offer.

You'll have to qualify under one of the closed work permit streams, then work for them for a year on that permit to qualify for the points.
