Hi folks,

My PGWP is set to expire in December of next year. I left a south american country to study here, since then the country has become an absolute disaster, for my personal safety and the future of my career I am determined to stay in Canada.

I have recently obtained a job in a high-wage position and am looking to obtain an LMIA to support my CEC application (currently sitting at 407 points (I know, it is very sad)). The position was advertised as programmer/analyst but I wear many different hats in the office. I noticed that one must meet at least the median wage for the position to qualify for an LMIA. However it looks like I am $3000 short (based of my annual salary (hovering at 70,000 at the moment)) to apply under NOC 2174 (Computer programmer analyst), however many of the main duties in NOC 2172 also apply to me. I am very indecisive as to which NOC code to approach, I understand the first would imply me asking for a raise, which although small in comparison to my base salary still means more paperwork for my company.

First question: How stringent is CIC when checking the actual duties against what I actually do? Like I said, I perform many things OUTSIDE of the job specification so I do not really fit a specific NOC profile.

Second, if we were to begin the hiring process. Should we start it now and then introduce the LMIA paperwork?

Third: I don't believe my employer has previous experience in going through with an LMIA, do you guys believe an immigration lawyer is required in this case? I've glanced at the paperwork and it does seem like a lot of work but I feel the additional lawyer fee will lower my chances of my employer going through with the application.
