Hi I'm new here. First gonna start by talking about us a little.

We met 4 years ago and started our relationship 3 years ago. He's from US and I'm from Quebec.
We are married since January 4th 2014, we filed the sponsorship June first 2014. I have a son and he have no kid. Now we are waiting to have new.
I'm confuse cause in the paper he read somewhere that it takes around 20 days to be accepted, so in April he left his job to come live here with me cause we thought it will be faster. Note on the job he will leave it anyway cause they were closing the building.... So we thought it was the good timing.

We were very disappointed to see how long it take to get the permanent residence, would be quicker for me to apply and go live in US but I don't wanna go there. So not sure I really understand that part, we are married, we have lots proof that we were traveling between US and Canada for 3 years, I was spending 9 weeks during the summer In US with my son for 3 years, he came every Holiday for 3 weeks and 1 week during spring. So why does it take so long? It said if I read well 15 month, you got to be kidding me, US take 8 month for the same things.

Now the thing is, since we thought it will take less than a month he came to live here, so now not sure how it will go, can he stay here? Is there anything else that can make it faster?
He applied for visitor till January 2015, so he can stay here.

Somebody can help me with good detail.

Thanks

Where did you read that it only takes 20 days?

Stage 1: Sponsorship approval, takes around 55 days right now
Stage 2: Applicant approval, takes an average of 15 months but I saw many people getting their COPR within 5-10 months

His visa is still valid until January so this could be enough time for him to get PR. If not he can extend his stay as a visitor by mail or online or just simply cross the border to the US and come back to Canada

it's important to note the "official" wait time for the OUTLAND applicant to be approved is NOT based on current trends. US Outland applications get sent to OTtawa, so it will not go to LA (where the wait time is significantly longer) unless there are red flags in the application (ie: issue with relationship/applicant). There are 2 current applicants from the us that finished the process in 5 months! The "trend" on this forum seems to be 6-8 months. I applied in March, and just received communication from the visa office, which hopefully means i'll be done around November.

While it seems like a long time, it really isn't. I hardly doubt getting a greencard in the US has that much shorter of a process than 6-8 months. The OTtawa visa office seems to be picking up the pace lately and we are all getting through the process a lot quicker than anticipated.

Perhaps the 20 days was for Sponsorship eligibility? That is the first stage in the outland application process. THAT wait time has gone up, and it fluctuates with the seasons, so it may start going down again. Again, the wait time isn't as bad as you are anticipating.

Thanks for your answer.

I know the paper will be returned to us because when we fill it online there was no code bar even if we validate. It wasn't saying anything so we thought it was good and sent them with all other paper.

Is it better to get it done by a lawyer? So no mistake will be done.

Whats about the Outland can you tell me a little more about it? Do we need to fill some more papers? I just want all that done, was waiting 3 years to have him with me.

Outland is the spousal sponsorship for permanent residency from OUTSIDE of canada. Even if you are IN canada as a visitor, student or worker, you can still apply as outland. There is a entire application for this, and i'm not sure what you submitted? Was it an entire sponsorship package? An application for a canadian to be a sponsor, and an application for your US citizen husband TO BE sponsored? If you sent in your application already, then there isn't anything more to do than wait. Again, it takes about 2 months for the sponsor's application to be processed, then another 3-5 months for the applicant's application to be processed at the Ottawa visa office. US applicants are getting total processing in 5-6 months, sometimes a bit longer.

I am not sure what paper you are referring to that needs validation? Again, as a US citizen, your husband does NOT need a visitor visa, so my guess is if you tried, it was rejected because he is VISA EXEMPT. All he needs to do is show up at the border. Having proof you have already submitted the application is helpful, as they will make it easier for him to cross. Technically, US visitors can stay in canada for 6 mo. Once in, he can then apply to extend his visit, and be there for the entire applicaiton process. Most PR applicants ask for a 12 mo. extension and they are rarely denied. As a VISITOR, your husband just won't be able to work IN canada during this time. If he has a US employer he can work remotely for, that is the best option.

I filed the IMM1344, IMM5540 and him the IMM0008, IMM5475, IMM5708, IMM5490 I think thats it. We sent lile 100 pictures and everything they asked.

When he came here April 2014 to live with me the border gave him a paper saying that he should return in US for the end of July thats why he filed for an extension online for 6 month.
They were scared he will stay here and never come back to US. Each time he's alone to cross the border its a pain when I'M with him its all good, just few questions and thats all.

I got the feeling all that paper work should be done by a lawyer to make sure everything is right and we get the quickest paper work possible.

You said ''All he needs to do is show up at the border. Having proof you have already submitted the application is helpful, as they will make it easier for him to cross.''

Whats about if they don't want to give him a paper to stay 6 month in Canada? Is it possible and if yes what to do in that case?

He's already in canada and applied for an extension. He doesn't need to leave to re-enter, as he already has permission to maintain status as a visitor. So ignore my statement about showing up at the border. If he intends to stay in canada, there's no issue. He can continue this status until PR is granted. If he needs to leave at some point, they will confirm his application at the border, and let him in. The paper he received is most likely a "visitor record". You are correct, they give those out to people they are suspicious of overstaying. They will sometimes give these out to a newly married visitor before your application is in so they can be sure you know and follow the rules. (I have had 2 or 3 of them) Since he applied for an extension online, he has implied status until he receives the decision. More likely than not, he will get through the entire PR process before that extension expires.

At this point, there is no point at getting an attorney involved because you've already submitted the application. It would be a waste of money, and i don't think they can help at this point. Hiring a lawyer doesn't guarantee a smoother process by any means. In fact there are many people on here who have received wrong information from attorneys, resulting in delayed processing.

Right now all you can do is wait and enjoy having your husband with you in Canada. Once the file is transfered to Ottawa, and the sponsor has been found eligible, the wait is "easier". The first stage seems to be the most stressful, in my experience. Join the june applicant thread to keep track of SA processing, and join the ottawa and us applicant threads to see how quickly people are getting through the process.

I'm not sure how else you are confused? You seem to be doing things the "right" way so far...
