ok so as some of you are following this case of mine here is an update...We (hubby and i) went to see lawyer yesterday...It went well...she said I have NO idea what complicated cases she deals with...mine is nothing in compared to those...people with major criminal records etc....so It was reassuring to hear that...you always think Your problems are the Worst...
Anywho, she will be submitting a Humanitarian&Compassionate consideration application to go Along with our spousal sponsorship....I didn't know that was possible (??)....she said at a recent CIC & lawyer "get together" CIC told all the lawyers to Please Don't scramble it ALL into one application....but send spousal one to Mississauga...and H&C consideration to Vancouver...That's how CIC wants it done apparently...and these 2 application DONT cancel each other...I specifically asked that...they are kind of together...a Family Sponsorship w a twist...so she gave me a form to fill out...wants me to get letters from family/friends etc
So then I asked her about a tiny lil issue called EXCLUSION ORDER...what should we do about that. she said I should call cbsa officer back like he requested ...tell him what she plans to do.
So I did that this morning...He asked if she will be submitting Deferral...for exclusion order...so I gave him her #....he then said he will Wait until she gets in touch w him....So I gave officers # to lawyer lady so they will get in touch and we'll go from there
My impression is cbsa aren't in a huge rush to "exclude" me....Seems like as long as she sends a form for deferral they will grant it.
The H&C consideration will be based on our 2 kids, marriage, my husbands Native culture, my establishment here etc....she said CIC does care a great deal about best interest of children...and thinks that it is in their best interest that the do live with both parents...this was stated by CIC at this recent seminar w immigration lawyers.
So I don't want to celebrate just yet....but it kinds seems I may have dodged this bullet...I was preparing to be sent back in a Month. She also asked if cbsa even gave me a date of removal ...and they haven't....so thats a good thing....I think
So that's that.....I feel like I can maybe relax a little.....but will see what lawyer says after talking to cbsa....
