My boyfriend is from Mali, West Africa. He is currently studying Business Administration on a student visa at a college in Midland, Texas. In the next two years, he is hoping to complete his bachelor's in business. Once he graduates we would really like for him to move here and obtain PR. Just not sure what's the best way to go abut it.

He currently has a visitor's visa to Canada which will expire in July. He's 31, speaks both French and English and is in great health. Just wondering if anyone had any advice on what course of action we should take as far as being able to live in the same country and both be able to work.

Should he apply for PR on his own merits as a skilled worker? Can he do that while he finishes school? Would he have good changes on getting in on a provincial nomination?

Should we go the spousal route instead? If we get married in Canada, he will not have the right to work for approximately a year, correct? Will the fact that he has studied in the states speed up the process at all?

Once accepted as a PR under sponsorship, would there be restrictions on us living in Canada or could we move back to his home country after a year or two?

Just trying to wrap my head around all this immigration stuff and getting the information I need so that I can then relay it back to him. Ultimately, he has two more years of school left but I know that these processes take time and would like to get the ball rolling so that it all works in our favour when he is done with school.

Any advice or thoughts from anyone who has already been through this would be very helpful

If you're sure about each other then why not get married now while he still has two years to finish his Baccalaureate. You can start the spousal sponsorship after marriage and by the time he graduates he would have probably obtained his Canadian PR.


Permanent residence status gives a non-Canadian the right to live in Canada. Permanent residents must comply with certain residency obligations to maintain their status.


Permanent residents comply with the residency obligation if, for at least 730 days in every five-year period:

they are physically present in Canada or,
they are outside Canada accompanying a Canadian citizen who is their spouse or common-law partner or, in the case of a child, their parent or,
they are outside Canada employed on a full-time basis by a Canadian business or in the public service of Canada or of a province or,
they are outside Canada accompanying a permanent resident who is their spouse or common-law partner or, in the case of a child, their parent, and who is employed on a full-time basis by a Canadian business or in the public service of Canada or of a province or,
they are in possession of a returning resident permit issued before 28 June 2002.
On arrival in Canada, permanent residents will have to demonstrate to the immigration officer at examination at the point-of-entry that

they have met the residency obligation in respect of the five-year period immediately before the examination or,
they will be able to meet the residency obligation in respect to the five-year period from the date at which they became permanent residents.
