Could senior please let me know whether it is ok to apply under FSW where the applicant has done his full time work as an international student visa as you konw most countries do not allow to work full time when you are a student. Is it an issue for Canada Immigration Office?

One more thing i did my IELTS academic in jan 09 with score of 7.5 can i still use this?

I do not know how are you going to do it this way !

Anyway, are you completely aware of the student off campus work permit rules ?

You will be allowed to work for 20 hours a week only (part time) during the study days (fall and winter semesters) and 40 hours (full time) during the official break (summer semester).

If you exceed the number of hours allowed to you for working in a part time base during the study days, they will revoke your student visa and ask you to leave the country.

If you mean to work continously in part time base during the (study days) and full time base during the official school breaks, and your work experience falls under skill level A, B, or O, they would accept that and grant you points for it as long as it is legal and proved by documents.

Another point, if you want to claim the points or eligibility based on that work experience and you do not have at least your undergraduate degree (bachelor degree or first degree) from your country before coming to canada, it is not going to work for you because your work experience that you claim for the purpose of the points or eligibility must have been done after your graduation from the bachelor degree(no work experience points can be granted during the study for your first degree).

For this point, they clearly state that applicants must take the IELTS test for general purposes not academic, so you have to follow their instructions in that regard.

The validity of the IELTS test is not more than one year from the date you submit your application to the CIO, Nova Scotia.

Thank you for your reply Professional 1 but i forgot to mention that my experiences were not from Canada and i was not there. So who will revoke visa? It was from UK and few years of it was full time and rest of it was part time.With regards to first degree there is no prob as i have first degree from back home.

In the circumstances above, what are the options to me? Can I go ahead without problem.

Not enough info on the type of work. For skilled worker applications, the question is always - what is the occupation? Is it skilled, (NOC O, A, or B?) And, do you think you qualify under Category 1 (List of 38 Occupations), 2 (Arranged Employment) or 3 (Working or studying in Canada for at least 1 year)?

If you can't answer those questions, you need to read up on the skilled worker program so that you CAN answer them...

I thought you are an international student in canada. Anyway, to apply under the federal skilled worker class, you have to be eligible same as any other one under any of the above three categories which jes_ON mentioned, and all of the required information will be avaible on the above link that he provided.

So - to re-state your question -

You have at least 1 year of full-time experience in an occupation on the List of 38 (Category 1). But you got that experience without the proper work permit in another country. Can you still apply?

You can always apply. No one can answer whether you will succeed. I would say, it depends -

1. Can you meet the documentary requirements of your employment experience? (Letters of reference from previous employers)? See the application instructions for more information.

2. Wherever you are now, and whatever you are doing - do you have all the proper authorizations?

If you can say yes to both of those, you may have a chance.
 
Yes from the employers side everything is ok there is no problem regarding employment contract and exp. letter. It was cpmpletely authorised by the company because they used to to give full time job to students at that time but now-a-days they do'nt hence I left the company. But my question is: Is it an issue for Canadian Immigration Authority that job was performed while on student visa, which we are not supposed to do except 20 hours per week.

hi DIPMM
i understand ur situation. in fact, i have applied for CANADA & i have shown my experience while i was a student in UK. i don't think there is aproblem. as per IELTS, i know it's valid for 2yeras. . so, u can send it as long as u can submit full docs to visa office during the 2yr time priod

I dont think this is correct.. work experience during the first degree is counted.

What if you dont even have first degree.. you sill can apply but with less points.

Job is not counted if the job requirements requires having university first degree. like medicine or pharma.. PMM probably can help more
