hello friends,

Please help me to get out of this situation, i am on pgwp here in Canada

I got ny pgwp in august 2018 and i started working full time from the first day of my work permit with the same employer

Initially i used to work with the same employer when i was a student here, wt that time i did part time work and then after approval of my work permit i talked with my employer that i need to get skilled work experience to be qualify for PR through express entry program

In august 2018 he said i will support you and will provide experience under NOC B (retail store supervisor), first you need to work 3 months as on probation period and then after 12 months or in November 2019 i will give you an experience letter for supervisor

But, now he is telling me that i have to work until july 2020 for an experience lettter and he cannot provide me a job letter in November

So, should i change my employer and wait for july 2020 or i find a new employer who will give an experience under NOC B after one year

I am so confused

Do you have anything in writing? A job offer letter? Change in job title, reflected on pay stubs? Pay raise to reflect the new responsibilities?

But, now he is telling me that i have to work until july 2020 for an experience lettter and he cannot provide me a job letter in November
Did he explain why?

he raised my pay by 1 dollar in november 2018 (exactly after probabtion period of 3 months after August)

He is now explaining me that simply we cannot give you a experience letter this year and you’re actual NOC B experience will be going to start in july 2019
 
Find a new job with actual not 0, A or B and not just proof of a letter.
Yes the thing is if i quit my this job now, then i am in lose of 8 months of my work permit ☹️

Is he saying that you have not been performing the duties of a supervisor, and that you are not actually being promoted until July 2019?

If that is the case, there is nothing you can do to rescue the situation. If your boss will not declare your experience as a supervisor, it will be classified as unskilled work experience. And if you believe he has lied to you once, then there is a good chance he will lie to you again - I would suggest finding a new job, ASAP.

Don't know, you haven't identified any written documentation you have - e.g. paystubs - do you have a job title on your paystubs?'

When you leave a job, employers are required to prepare a Record of Employment - they either have to give it to you within 5 days of your last day of employment, or submit it electronically to Service Canada (where you can download it). This can be used as proof of employment, however, it only helps so much if you don't have any written job description that attests to your duties/responsibilities.

  • Your work falls under any of the NOC which will allow you to apply through CEC.
If this is the case, even if he does not want to give you this letter, CIC clearly states that is you cannot provide this letter you can justify and explain your situation.

May I ask what did you study? It seems to me that you could do something else? Anyways, you can switch jobs and use both experiences combined towards your minimum requirement.

I have my all paystubs but the this is it doesn’t mention itself my position though it shows my salary details plus how many hours of current year and other tax related information

As a letter of employment he will only provide me a letter which describes me as a noc c employee in the company nothing else

Yes i have been working legally since 8 months (August 2018) as my employer told me that he will provide a letter for job under NOC B but now he says after more than a year as on July next year

He agrees to write all my experience as i am working at a gas station and he will write just a cashier from first day of my job until july 2019 (11 months) and from july 2019 to july 2020 as a retail sale supervisor (noc B)

In my sense i will only obtain one year experience points in this way? Correct me if i am wrong

Almost certainly you would only get one year. However, you must have some sort of contract or something where it describes your role. If your current role is actually that of a cashier a not a store supervisor, then there is not much you can do.

On the other hand, if you are currently performing a job which would allow you to qualify for Express Entry (based on it's NOC code) you could explain in your application that the employer has refused to provide this letter and submit any documentation to prove this (contract, T4 forms, pay stubs, etc) along with your job description.

Since your work should be all legal, you should have most if not all of these.

Certainly if you are working as a Store Supervisor but are being refused a letter of reference that is certainly your bosses fault. In that case, do you really what to work for such an employer?

Honestly, I would say run away. What if next year he says you know what, I am not giving you anything. He did it once already he might very well do it again don't you think?
 
You need to find a new job. Your current employer is clearly taking you for a ride and taking advantage of your need for work experience.
