Hello,

I got a valid job offer from a recruiter who can handle LMIA.
He suddenly wants to give me a better position NOC which is different from his original job ad NOC.

In this case, can I apply for a work permit with that different NOC?
He's been advertising for more than a month only to not be able to find any person who's interested in working with him.
or should he put an ad for that different NOC for a month before letting me apply for a work permit with that NOC?
I wonder if he can simply use that original ad as a proof and hire me with a different NOC.

In normal life, this is possible and no one will think this is an issue....
 
I am not an expert, but like in EE - there is no rule that says the LMIA has to be related to your profile NOC, however, LMIA is specific to position so... hm... i would be in doubt.

Worth talking to a lawyer.

I would say that this is the safest option for you and for employer..
 
But, I would like to hear more opinions on this.

If you guys have experienced similar situation and had no problem, please share your opinion on this matter.
