Dear all,
My current status in Canada is multi-entry TRV valid until January 2021., and I will apply to a permanent residence (PR) via in-land spousal sponsorship soon (I'm married to a Canadian). My foreign (Chinese) passport will expire in January 2021, on the same date that my TRV will expire. An immigration consultant recommended that I renew my passport before submitting the in-land spousal sponsorship application, because this application will allow me to get an open work permit (OWP) but the validity of the OWP cannot pass the passport's expiration date, so if I apply with a new passport I'll get an OWP that lasts longer.

However, another immigration consultant advised against renewing my passport now. She said that if I do so, I'll lose my current TRV status because it comes with my old passport.

Which of these consultants is right? I'm very confused. If I renew my passport now, will the original validity of my TRV still apply before its expiration date? Could you help me please? Thank you!!

(By the way, when a Chinese passport is renewed, I'll get my old passport back together with a new one, and the cover page of the old passport will have its top-right corner cut. I thought I'll be okay, as long as I bring both passports when I travel.)

Your second consultant is wrong. The validity of your TRV has nothing to do with your current status in Canada, and a still-valid TRV in an old passport is still valid as long as it hasn't expired. You can still use it provided that you bring both passports and it isn't expired.

Of course, your status in Canada either expires six months after you come to Canada or a shorter date stamped into your passport. Even if your TRV is still valid, the status can expire.
