i became a permanent resident in June 2010. i got a job but my employer want to send me to the UK to search for business opportunities and clients. its a one year contract. i just want to know that this one year which i am going to spend in the UK will count towards the 730 residency requirements. i have UK work permit and spent 5 years in the UK. my employer is running accountancy firm.

Please give me a detailed answer so that i can fully understand my situation.

Looking forward to hearing from you

I have read a number of posts on this topic. The search button should help you find them.

The gist is that yes, if a `qualified`Canadian company sends you abroad, those days count toward your PR quota of 730 days.

But as PMM cautioned in one of those posts, only certain types of Canadian company qualify. So be careful, and if those days count, research how to prove those days, and keep that proof handy when you renew your PR. Maybe all you need is pay stubs and bank deposit receipts, or a letter from the company saying you are working abroad for them (place and period). But if you don`t keep those proofs, getting proof after the fact may be difficult.

to toby,

thanks alot for your prompt reply. could you please guide me which companies are qualified and which are not?

Sorry, I don't know the definition; I've never researched this topic since this situation does not apply to me. I believe the CIC website discusses this situation as well as this forum: try searching for "working for a Canadian business abroad" and hopefully you will find what you need.

can someone in this forum guide me regarding company definition. as i will work for my employer outside Canada. he is running a consultancy(Accountancy) firm here in Canada. if i go abroad and work for him from there, will it count towards 730 residency obligation?

please give me reply asap.

regards,

shah

6.2. Canadian business
The definition applies to both large and small businesses, and includes:
• federally or provincially incorporated businesses that have an ongoing operation in Canada;
• other enterprises that have an ongoing operation in Canada, are capable of generating
revenue, are carried out in anticipation of profit and in which a majority of voting or ownership
interests are held by Canadian citizens, permanent residents or Canadian businesses; and
• enterprises that have been created by the laws of Canada or a province.
Note: The definition does not include businesses that have been created primarily to allow a permanent
resident to satisfy their residency obligation while residing outside Canada [R61(2)].

thanks a lot for your reply but my question is very specific, that is my employer(Charter Accountant) is running a Accountancy firm. i just wanted to know if he send me abroad for 1.5 years, will it count towards 730 days residency obligation? he is running this firm for that last 10 years and its a registered firm.

My answer is very specific, if the company meets the above definition, and they hired you in Canada, and then you were transferred to an overseas office, then the time would count. Only you and your employer knows if the company meets the definition.
