Hello all,
I'm from the UK and came back to Canada on July 14th with my Canadian wife after living abroad.
We returned to Canada suddenly due the loss of our child so it took us a couple of months to get everything together for the inland spousal sponsorship application and open work permit. We missed a signature so the application was returned then we re-sent the application but it was again returned today (December 14th) because I didn't include my passport or birth certificate, as i thought they only needed copies.

It takes about a month before they even start to process an application so it's likely that it'll be after my 6 month visitor visa expires on January 14th. What are my options? If I resend my application now will I have applied status? We're super stressed and don't know where to turn for answers

Any help would be greatly appreciated.

Hi

They do only need copies. You don't send your actual passport or any original documents. What exactly did they say?

Assuming you are including an OWP app with your inland PR app, you will have Implied Status. However, to cover your bases, apply for a visitor extension before your current visitor status expires.

They send an automated letter along with a yellow supplement letter with the title 'Identity and Civil Status Documents'
On the yellow letter they highlighted the sentence 'You must provide the required identity documents for YOU (the Principal Applicant)'
but they don't highlight that the passport or or birth certificate wasn't included. I included copies of those documents so i don't know what the deal was.
We also missed another certificate which they highlighted so maybe they linked those two parts. It's confusing.

I'll apply online for the extended visitor visa but I hear that you have to do that 30 days before expiry so i'm already late.
What happens if they return the application again for whatever reason? Will I be classed as overstaying?
If so will I be banned from the visiting my wife in Canada?

Double check you had everything but don't send originals.

The 30 days is a recommendation, not a requirement. You can apply up until your status actually expires.

As long as you have applied to extend your visitor status prior to expiry, you will have valid status.

They suggest 30 days. You can apply the day before your status expires if you really need to
