hi! i am new in this forum. i was here in Toronto, Ontario as live-in caregiver last april 2008. then I met my Canadian husband in March 2009. I continue to work as live-in caregiver til i finished my 24 months in april 2010.. I got married to my husband last may 2010 applied for marriage certificate 3 weeks after the marriage.

We submitted an inland Spouse sponsorship because this what my friends to do so instead of applying PR for live-in-caregiver. I stopped working as Live-in after the marriage because the immigration might question our marriage. Because if I continue working as live-in,meaning.. im going to stay in my employer's house.

I dont know if I did the right thing. We submitted the inland spousal sponsorship on September 12, 2010. But until now, we haven't receive any feedback from the immigration. I dont see any progress in E-cas too. Please give me some advise. Thanks a lot!

As you applied Inland, it will take approximately 9 months for first stage approval.

Might be best to do a search and read through some of the Inland threads to find out more about the process.
 
They are currently assessing inland applications received through March 6, 2010 - so you're not going to see anything in eCAS, or receive any correspondence from CPC-V until sometime in May or June of next year. That's when your application will be assessed for first stage approval.

I don't know anything about the live-in caregiver program, but if that was your temporary status and it's now expired without you doing anything before expiration to extend your status, you'll probably find that your application gets transferred to your local CIC office when they finally open it to assess it for first stage approval - and that can delay processing significantly, depending on how busy your local office is. In the meantime, you have to remain in Canada now for as long as this takes because if you leave and you're not re-admitted, you lose the application. Too bad you didn't find this forum before you submitted your application - in fact, before your live-in caregiver status expired and then you got married. You would have been better off to marry before your status expired, and then submit the PR application with an extension application to keep your temporary status in Canada valid. Because you married after your status expired, it's could look to them like you just got married in order to stay in Canada, so I hope you submitted lots of proof of your "genuine" relationship.
 
You will not hear from CIC before 9 months. You can call CIC call center after few months to check if your file is in queue. You can check the time line at: http://www.cic.gc.ca/english/information/times/perm-fc.asp
 
Unfortunately, it looks like you did the wrong thing by choosing inland spousal sponsorship over applying for PR as a live-in caregiver. Completeing the 24 month contract made you eligible for PR as a live-in caregiver if you completed a total of 3900 hours of work and you could have applied for an OWP at the same time. I am at least hoping that you applied to change your status from worker to visitor.

Just a note, if anyone is eligible for some of the economic stream programs (PNP, CEC, etc.) or live-in caregiver program to apply for PR, it is a better choice 99.99% of the time unless you have a medical condition that would make you inadmissible or there is a requirement for large settlement funds. It is best to explore the requirements of these other programs if you are eligible for them before making a decision.

These programs are not subjective like the spousal/partner category. You don't have to "prove" your relationship to someone and count on a perfect stranger's assessment of whether it is genuine or not. These other programs have clear rules and are very black and white in the assessment of eligibility. While you still have to provide supporting evidence, it is much more concrete like copies of work permits, records of employment, employment contracts, etc.

If you are eligible for one of these programs, especially people currently in Canada, please get some legal advice before choosing spousal/partner sponsorship. It would be awful for this OP if the IO assessing their application refused her because they didn't believe the marriage was genuine yet the OP could have avoided all of this by applying for PR as an LIC. I am NOT saying this will happen just that they chose the more difficult road IMHO.
 
I applied for the Inland Spouse sponsorship rather than under Live-in caregiver because I have to live with my husband's house. One of the requirement of PR application under Live-In caregiver is that you have to finished 24 monthts of being caregiver ( which I did) and still working on your employer ( I didn't). I stopped working as live-in caregiver after completing my 24months becuase i have to live with my husband. I cant use live-out as an option because this is illegal under live-in caregiver.. My work permit will expire till June 2011 so i am still holding a valid work permit. I didn't add an OWP application with my application too.. now I am a bit worried with my application most especially I can't even have an idea what's going on with my paper in Vegriville... :(

Since your application was only just received a couple of months ago, it's not even in process yet. If you believe your best option for applying for PR is as a spousal applicant, then I'd suggest that you get advice from rjessome about whether or not you are eligible to submit an application to extend your stay, choosing the Open Work Permit option ($150), and including a cover letter with the extension application notifying CIC that you have submitted an inland spousal PR application and that you don't want the extension/OWP application to be processed until you've passed the first stage of assessment on the PR ap. If you provide the proper information - name, address, client ID#, tracking receipt for the original PR ap - with the extension ap, they should be able to "match" the two together and, hopefully, you'll be approved for first stage and they'll issue you an Open Work Permit as your new temporary status. In the meantime, as long as the extension application is received by CPC-Vegreville BEFORE your current permit expires, you're protected to stay in Canada. You can't work - at least not for a different employer or in a different job than a live-in - but you'll have valid status to remain in Canada, and then after AIP, you'll get an OWP which allows you to work anywhere.

Again, hopefully I've got this right - it's the way the process works for other inland spousal applicants who have valid temporary status when their PR aps go for assessment to CPC-V. It's just that I haven't heard of many live-ins who actually stop working and then apply for spousal PR while they still have a valid work permit. I'm pretty sure the same principles apply, but I'd really like rjessome to validate this because she's a certified consultant and would know better than I do.

Happy that your status is still valid. That's a definite positive for you in many ways.

RobsLuv has it right except for one thing. You cannot apply for an OWP until you get first stage approval. You have to wait for the results of first stage processing. If you don't get AIP and they transfer your file to a local office, you can apply for a change of conditions from LIC to visitor before your current work permit expires. That will keep you in status. If you do get AIP, then you apply for the OWP.

Like with any inland processing, there is not much you can do now but wait until they get to processing your file which is 8 to 10 months from the date of receipt. Expect to hear something between May and July. Just make sure that you stay in status because if it takes them longer to process your application, you must still apply to extend your stay before your current permit expires.

So be as patient as possible right now because it's out of your hands.
 
I have also got a letter from Singapore dated 2nd december to send my PR fees.. they sent me all proofs like pics and wedding card..In addition with that they also asked me to provide my personal history since my age 18 coz there was some gaps betwen times ..and the address part of mine since 18 years coz there was also some time gaps....Basically they put a tick on those ( Landing fees, Personal history form)

could u plz tell me how to complete that form and how can I be more precise to complete that personal history ( Question 11 of IMM 0008 Schedule 1) form...How did u completed that form..plzz help ..

if i want to work as live-in caregiver while my application is still in process, is that possible? I mean for a different employer now since I finished my contract already with last employer (which I worked for 24-25 months)..

If yes, I still need to send application again for work permit for different employer. Or just be patient waiting for my inland application to avoid confusion for the immigration.

hi applied for inland spousal sponsership in 1st-sep-2010 but did not recieved anything. they are currently processing 17 april 2010.
 
Don't worry, it'll take a few more months until you hear from them. Check the CIC website and you'll read that currently it takes 8-9 months before they process your file.
 
I called the CIC immigration last Monday January 24th. The lady said they start processing my paper end of November 2010 but she didn't tell the exact date. Then I called the next day again to verify the exact date. An accent of Indian guy answered my call. He didn't even asked my name and client ID. He just said, wait for 8-9months. awww! Some CIC representative sometimes are lazy to look at the status of the callers, where applicants like us are too eager to know what going on with our applications. But yeah, I try to call again... :)) Lets hope and pray for the best!!!
