Hi there,

I'm looking for information you guys might know about this topic.

I have been in Canada since spring 2014. I came under Working Holiday Visa (open permit) for a year. Got approved for a second Working Holiday Visa (closed permit) for another year. Was here as visitor for 3 months between but out of status since winter 2016. Currently living with my partner since beginning of 2020.

I'm looking what options I have. It seems like federal government changed opinion about giving PR to undocumented people.

I know there are options about inland sponsorship through my partner (Canadian citizen).

I'm worried about the length of the stay without status. Will it cause problems while applying? Does my partner need to prove sufficient income for such application (found some information that proof of income is not necessary for common-law sponsorship)

Also I do not have a valid passport (Czech Republic). Expired in 2018. But I have a valid Ontario drivers licence

You can and should apply for PR under spousal sponsorship.

Your partner does not need to meet income requirements but cannot be on social assistance.

Ideally you should find a way to renew your passport.

Canada has been very generous regarding undocumented spouses/partners for a very long time. An Inland (SCPLC) spousal sponsorship applicant does not need to have legal status in Canada.

You may have no choice but to renew your passport. Your Ontario DL will not be accepted as a primary identity document for sponsorship.

Thanks guys for info. I'm trying to figure out how to renew my expired passport with no status.

Based on Czech embassy this is one of the requirements to renew expired passport: Applicants who have not acquired Canadian citizenship must prove this by presenting a "permanent resident card" or a passport with a valid Canadian visa or any other document proving that they are not Canadian citizens.

I'm going to have to ask them if they would accept affidavit letter stating that I'm not Canadian citizen as that what it seems to be about.

Most countries won’t renew passports if you are out of status. They will typically provide emergency travel documents for you to return home. You may have no other option but to return home to get a valid passport so you should consider applying Outland.

Thanks. Still trying to get as much information before I start any formal application. My partner is applying for his Canadian passport as he never left Canada, so I still have some time to figure things out.

Does anyone knows if Embassy is required to report people with no status. I want to send them email and ask them about my options. But obviously I will have to be honest about my situation here.
