I am in the process of applying to sponsor my common law partner for permanent residency. We are applying inbound but I wanted to double check one thing before we apply.

I was previously married to an American citizen from 2007-2010, we separated in 2010 and she moved back to the USA (no immigration papers were ever filed for sponsorship etc. she just stayed for six months at a time). However we had little to no contact so it took a considerable amount of time for the divorce to be finalised, it was finalized in July 2017 even though we haven't seen eachother or lived with eachother since 2010.

I have been living with my common law partner for two years and I intend to wed her in 2020. I plan to provide a detailed explanation of my previous marriage / divorce with the application but I am wondering, when it says to give the dates of my previous marriage, do I do 2007-2017 or 2007-2010 when we separated and she moved back to the states. I think I know the answer but just wanted to double check to be safe. It would be an expensive error to make.

Any help would be appreciated.

2007-2017. Your marriage is only ended, after it is legally dissolved.

Thanks for your quick response can I ask two other questions? If Ive lived with my girlfriend since 2016 and we became commonlaw in 2017, does it affect the application if there was overlap before the divorce? And also if the date for entering the commonlaw relationship should be 2017 after we were living together for one year? Many thanks!

Include a letter of explanation and there will be no issue. You became common-law one year to the day after you started living together.
