Hi guys,

My partner and I applied for inland common law sponsorship with an OWP attached before my work permit expired in Feb 17, 2015. I understand this gives me implied status while the application is being processed.

Before my work permit expired I also applied for BOWP, in case my FSW from December 2014 was accepted. Though recently received NER due to insufficient points. Now.....It still might come through as I received AOR from Express Entry today and they still haven't processed the BOWP. Hopefully it works!!... but I am preparing for the worst.

So here it goes.... if my BOWP is rejected. Do I have to stop working? Or technically I am still under implied status based on my Inland application? Really confusing situation...would appreciate any input.

I took a look at some of your early posts and it appears that your work permit that recently expired was a PGWP, correct?

If so...there has been MUCH debate here as to whether or not a person can continue to work under implied status if they have an expired PGWP. The overwhelming consensus seems to be...no. A PGWP cannot be extended and the OWP that a person is eligible for with an Inland application is a different type of WP altogether.

Just to clarify, your implied status is NOT because of the Inland application, but rather because you included an OWP along WITH the Inland application. This definitely gives you implied status to remain in Canada (as a visitor), but may not allow you to continue to work.

I'm sure there will be others to offer their opinions as well.
