Hello all,

Finally stumped on the common law sponsorship so looking for some advice.

My Canadian girlfriend of 3 years is sponsoring me in Canada. After meeting in NZ and moving to Canada on an IEC visa. We arrived on 10/17/18 and so have until at least 10/17/19 to become officially common law partners. Luckily my IEC visa will have another year before it runs out. Perfect!

However, looking into the whole inland or Outland application fiasco. Should we apply inland with a open work permit to avoid any delay risks in the application process next year. Or apply Outland with no open work permit and hopefully get a quicker processing time on the application?

To make things more complicated we are heading to my best friends wedding in Scotland (also my home) in April for 5 weeks. This of course has the added risk of leaving the country on an inland application or we could just applying Outland and hope it processes quickly.

Or of course we could just leave the application until we arrive back in Canada in May with 3 months left on my IEC. Then maybe apply for OWP if needed and even possible.

I’m also not sure if applying for an OWP now would cancel out my IEC when it is approved and if that could prove difficult/risky for our wedding trip to Scotland.

Maybe I’m just overthinking this, but any advice would be greatly appreciated.

Did you live together in NZ? When will you actually have one year of continuous cohabitation?

No we were only able to start continuous cohabitation when we moved to Canada. But we were not going to apply for sponsorship before we are officially 12 months living together. This will be on the 17th October 2019, which we have enough evidence such as bills, rental agreement etc and relationship evidence from NZ onwards to prove we are in a marriage like relationship.
