Hello everyone,

It's great to see this online community and all coming together and helping each other. I wish all the best to the applicants and their family members aspiring to settle in Canada and may their dreams come true quickly!!!

I have few questions which I wish to ask here regarding sponsoring my common law partner.

Background:

I am a Canadian citizen currently residing in India since 2014. I met my partner in Canada and we have been in a committed relationship for more than 10 years. My partner was in Canada on a student visa. He completed his education and moved back to India and I decided to move with him in 2014. We have been living together in India since and we have also completed higher education in India together from the same university. I am also staying together with his parents in India, But we are not Married yet, though his parents have accepted me as their Daughter-in-law and support our relationship and our decision to get married as per our wishes. They have also been supporting us financially. I was working full time in a Finance company in Toronto before moving to India. I held that job for 4 years, I have the T4's and NOA's till 2014 to prove the same.
Now we have decided to move to Canada together and I am wishing to sponsor him.

Question:

1. Since i am living in India on a visitor/student visa, I have no Income in India or in Canada. How will this affect my sponsorship application as I am not able to prove my financial ability?, though my family is willing to gift us money in Canada as our start up fund and his parents are willing to do the same and we can have this documented along with the application at the time of filing.

2. if financial gift is acceptable, then how much money will be required to prove my ability to sponsor my common law partner.

3. Does it matter that we are from different nationalities? We have been living together in India since 2014, will this be helpful?

My partner seems to think that moving to Canada will take too long as he has good job opportunities in India but I am afraid that I will not be able to live in India for the rest of my life.

Its a long story but I hope you guys understand and provide some information relating to my query. I wish to prepare and file for sponsorship as soon as I can but I am afraid that CIC might reject it because of the above concerns.

There are no income requirements for common-law sponsorship so this answers questions 1 & 2. What they look for in terms of finances is that you have shared expenses and support each other, for example a joint bank account or bills you both pay. A letter from your families saying that they support your relationship and would help you financially if you needed it, is good to add to your application but it's not required they give you any money.

To answer question 3, no. Canada is about diversity and multiculturalism and as long as your relationship is genuine then you should have no problems. Definitely having lived together for 4 years will help, make sure you have proof of this.

Not quite true. There is no income requirement but you need to show how you will support yourselves without needing government help. You can show saving from previous employment, if you have a jobs lined up you can mention that, etc. Money transfers are a big red flag but you can include proof from your parents that they are willing and able to support you in Canada. Only parents living in Canada should provide letter, and banking info.

Thank you for your input. I had been living in Canada for over 18 years. I was employed for 4 years in Toronto after I graduated.
I can find some reference letter's regarding my work if those would help.
I wish one could save enough while living in Toronto to last them for over 5 years in another country:-))
I have income documents from my previous job which I could provide. My partner also held a high paying corporate position for few years before we moved to India. We both worked in Financial industry in Canada and have compatible education.
Our parents can provide us with financial support but none of them live in Canada.

How else could I prove financial stability without transferring funds into our bank accounts in Canada ??
Why would it raise Red flags ??
Is Cad$ 50K enough to prove that we can support ourselves without needing government help ??

I am a Canadian citizen and I have never applied/received any welfare/social assistance in Canada nor do I have any student loans or any other loans outstanding.

I am very much concerned, but I am not willing to move to Canada alone and file an application from there after finding a job. One can easily find a suitable job once they are in Canada even a minimum wage job thus eliminating any need for social assistance.

Previous employment information is not needed. You will need far less than 50k to show that you can support yourself. Under 10k is probably what they are looking for or proof that your families will be able to support you based on their savings. They just want to see that you will have enough money to live on until you are able to get jobs and start getting paid. You have to remember that the sponsorship process applies to many different people in different circumstances. Transferring funds raises an red flag because it may only be temporary loan and you may be required to transfer back the funds. Include both your personal savings, your plans for employment (both of you), a letter from your parents offering free accommodations until you are able to move out on your own and a letter stating that they will be providing financial support for the both of you until you find employment. Your parents should provide banking statements and/or employment information (if possible).

I live in India and my spouse has a PR of Canada and lives in Canada. He is sponsoring me under family class in the PR Outland category. So just needs some clarification on few things regarding the form:

In document checklist above Part-B 5. Class of Application there is note which states that:
Note: You(the principal applicant) must declare your family members(accompanying and non-accompanying). If you do not it may result in the refusal of your application.
So my question is where do I(principal applicant) need to declare my family members, who all fall in this category and what are the document required and where to attach that documents?

And we don't have any child yet so do we need to tick the box of Financial Evaluation and show our income proof?
 
Family members in this context means dependents (eg your children). The rest should be more clear after that, ie I don't believe you need to do the financial evaluation, but please check.
