In case of refusal, did the CIC London send the whole documents back? or one can request

Please advise,
 
Hi I have one question if some one clear my question who make the decison on application visa office of CHC OR CIC .

Also I got resfual I applied in nov 2005 visa office isondon I want to make new application will my new application will affect by previous decison .
 
CIC is the Canadian Immigration authority

CHC is the Canadian High Commission where CIC process aplications (these only exists in certain countries like UK) otherwise CIC offices are based in similar premises such as Embassies or Consulates General.

If you were previously refused it depends on why, you must show that you now qualify.

thx for your reply I got your point I checked the FSW I qualify in that scheme but when I will apply in FSW scheme will my that application will be affected by previous application .
I have checked CAIPS and I found this thing <FOSS> is a central database of applications which is used in this case to verify that the applicant has not been refused a visa from other visa post .

FOSS CHECK:NO RECORD OF APPLICANT(S)OTHER THAN OF THIS CURRENT APPLICATION IN PROCESS.

when I will make new application so the previous application will come up on their system and showed that i got resfued.
can u clear my this confusion.

FOSS (Field Operation Support System) is the system used by Immigration/CBSA in Canada to record all the actions taken on client in Canada or entering Canada. CAIPS (Computer Assisted Immigration Processing System) is used by Immigration offices overseas for processing cases. Overseas offices have access to FOSS and Canadian offices have access to CAIPS.

can you help me when we apply for immigration our file/data record in FOSS OR CAIPS , my case is that I have applied in nov 2005 from CHC london and recently i got resfused now i am thinking to apply FSW scheme I can qualify for that scheme but I am worried when my application reached to SYDNEY office under FSW scheme so do they have record of my old application and will my old application will affect on my new application .
any one help or advice will be very helpful.

Your old refusal will be in CAIPS and probably downloaded to FOSS. Sydney will check CAIPS but if they approve for further processing, the overseas office will look at the previous refusal. They definitely will check your new application against your old one.

and if the overseas offices are different then in that case what will happen .
Also I have one question for canadian immigration they accpect any degree like I am living in uk but my awarding body is from ireland is there any problem/

There is a specific performa of denial/refusal letter. Only that denial letter and enclosed documents are returned. All the forms IMM008, Schedule 3 and 4 will be kept for future records.

first, you are required to declare (Schedule 1 Background Declaration) if you have ever had a visa application refused

of course, CIC will keep a record of your prior application and cross check, if you don't declare this you will most likely be regarded as inadmissible for making a false declaration

your degree from Ireland should not be a problem
