So I don't know what to do.. I went to the customs thinking an immigration officer might know how I sponsor my spouse here, my husband is currently an overstay cause at the time when we were going to apply for an extension they were on strike so we moved from where we first were got situated and are ready to do the sponsorship, so know anyways I gave them all information cause the immigration officer said in order for my husband to start the application he got to get a status in Canada so I thought that was a good thing he said possibly a permanent residence permit or something along those lines. Next thing I know we are getting a letter in the mail to come down to the office cause he may be inadmissible , so we go there and yes they seized his passport and he got 15 days to do prra or go home, I really want to do the sponsorship application till now don't really know how because the immigration people said they don't know anything about it and really don't want my husband to leave me cause they said if he is removed and cant come back for a year... can someone please help me on any of my situation I am really stressed and my friend said this would be the best place to get advice thanks guys... :)

I am only replying because this wretched magician is fouling up the forum and the knowledgable members of this forum (many of whom will be fast asleep in Canada at this time of day) may be deterred from reading the messages until the magician's nonsense is cleared from the forum. First thing to do is to clarify the facts. (1) You do not say whether you yourself, the proposed sponsor, are a Canadian citizen or a permanent resident of Canada. You need to be one or the other before you can sponsor your husband (2) You do not state what your husband's nationality is; that determines whether he needs a visa to re-enter Canada or whether he is exempt from that requirement. (3) You have, I assume, access to a computer? If so Google CIC's literature concerning family class sponsorship, print out the relevant forms and advice notes and read them thoroughly. They will probably raise a number of questions in your mind, but first of all find out what those questions are. Then we can all give better advice! Post a reminder on this thread once you have done all that and if no one else more knowledgable has answered your queries by then, I will add to what I have written. If you need the reference numbers of the documents you need to read, I will gladly give them to you; but try for yourself first!

To Wowsers, you are spot on about the continuous spam putting people off from reading the forum.

To Candyj, It's odd that they would have suggested a PRRA, as this is normally for those claiming refugee status.
However, you have accidentally woken up the CBSA dragon and this is not a good situation to be in. In my humble opinion, there is almost no point in attempting an "inland" sponsorship at this point, mainly because your husband is already under a departure order. The "inland" administrative deferral will almost certainly not come in to play.

If you want to avoid a huge amount of hassle, it might be best if your husband complies willingly and leaves. This then allows you to make an "outland" application for sponsorship. If your husband is able to legally re-enter Canada, either as a visitor or as a temporary foreign worker, the "outland" application can still be ticking along in the background.

it's a shame that you didn't find this forum before talking to CBSA. We could have pointed you at an alternative path that would heve probably been less disruptive.

For reference, the PRRA information is here -> http://www.cic.gc.ca/english/information/applications/guides/5523ETOC.asp

Good luck.

Agreed. Your only real hope is to have your husband leave voluntarily and file an Outland application.

FWIW, The CBSA Administrative Deferral program apparently ended in November of 2011.
