I agree. It's rather "misleading" of CIC not to mention specific rules like that when applying, since it's seems to be a common mistake to make by continuing to work beyond the expiry date of an IEC visa. However anyone should know that when obtaining the IEC visa, the officer gives specific instructions what you can and can't do, and I clearly remember there we couldn't work when it runs out - no exceptions. You must apply for a 2nd "young professionals visa" where you need to find a employer who's willing to get you a years contract. If your country doesn't have this visa, then it's either live with it, or travel home. Period.

Hopefully you don't get in trouble with it that's all I'm saying.

Since IEC cannot be extended as per CIC, the applicant should know that it does not give them implied status while they wait for 1st stage approval and OWP. I know they should make it more clear, I think there is either an IP or OP that has detailed information about bridging if I find the reference I'll post it.

There is some form of bridging with PGW visa but there is no bridging for IEC visa.

I believe there is if you are applying via cec route screech.

This is very confusing. I spoke on the phone to CIC and asked what I needed to do with regards to my IEC visa and they told me explicitly that applying for a work permit extension at the same time as my spousal sponsorship would extend my current situation and I would be allowed to continue working in my current job. I've been very vocal about it being an IEC visa and they explained that the work permit extension would cover that. Although I haven't heard any response regarding that application, which was sent in with the spousal sponsorship application. I've already had approval of my sponsor and my medical. They haven't flagged up any issues yet and have been made well aware that I am employed and currently working, and I traveled on IEC. Is there any government issue paperwork anyone has that confirms that I can't work in these conditions?

Hope this answers your question.

Hey guys, I received this email from CIC that might answer our questions about the implied status for IEC and PGWP.

Note the "*" in the end of the message. It states clearly that international youth exchange programs do not apply for Implied Status.

At the same time, it clearly states that this relates only to international youth exchange programs. That means it does not apply to PGWP. So yes, people with expired PGWP are indeed allowed to continue working under implied status.

Sir, Madam,

Thank you for contacting Citizenship and Immigration Canada. I am pleased to follow up on your request:

Implied Status - Temporary Residents

As a temporary resident (TR), if you send your application for an extension of your authorization to remain in Canada at the latest on the expiry date of your status, you will be considered in status as a TR until a decision is made on the application. This is known as an Implied Status*.

If you hold a work permit or a study permit, you can continue working or studying under the conditions of your previous permit if you have applied to extend your stay in Canada under the same category. However, if you have applied to extend your stay under another category, you must stop working or studying.

If you leave Canada while under implied status, you may be authorized to:

Re-enter Canada as a TR, if the Case Processing Centre (CPC) has not yet made a decision on your application to extend your work permit. Please note that you will not be permitted to work/study until you receive your new permit. You must satisfy the officer at the port of entry (POE) that you have sufficient means of support. This applies if you:
are temporary resident visa (TRV) exempt;
held a valid multiple-entry visa before leaving Canada; or
travelled only to the United States** and/or St.Pierre and Miquelon by the end of the period initially authorized for their stay or any extension to it;
Re-enter Canada as a worker/student, if the officer at the POE determines that your application to extend your work/study permit was approved by the CPC while you were outside Canada;
or
Apply for a new work/study permit at the POE provided you have the right to do so under the Regulations.
For more information on implied status, please consult the Operational Manual - Overseas Processing (OP 11) - Section 24.

* Participants in international youth exchange programs (e.g., Student Work Abroad Program (SWAP), International Experience Canada (IEC) or Working Holiday Program (WHP)) do not benefit from implied status, unless extending a work permit not initially issued for the time limit authorized by the program.
**Including its Territories and Possessions.

OK, so I spoke with CIC just now. They told me that regardless of my entry being IEC, I gained implied status because I sent in the OWP application along with the spousal sponsorship paperwork. She stressed that the IEC aspect of it would not affect my right to work. So...I'm confused. Because I heard from them that it's ok, I'm going to go along with it...

This has all been very confusing and a little worrying! But thanks for helping me out. I really appreciate you guys being so quick and willing to offer information. This whole application process can be a bit overwhelming.

Just so you know, there have been reports of people getting caught working illegally pass IEC expire dates and got deported.

Also remember the people who answer the calls are front line workers to address calls to repeat what's written on their computer screen.

There was an episode on Canada Border that showed the IEC workers getting caught working pass their expire date because their thought they were on "implied status".

We been through this discussion at length in the link I provided.

If you want to continue working pass your expire date, do it on your own risk and no one else's. You can't even blame the CIC call agents for it either.
