Hello Forum,

I am currently working on a "Post Graduate Work Permit", which expires Jan-2017 and my common-law spouse and I are getting married next week (We've been living together for over 3 years).

QUESTION 1: Will I be able to get implied status as a PGWP holder after it expires.
QUESTION 2: Should I just apply as common-law instead of waiting for marriage certificate.

1) If you apply inland, you'd have the work permit long before your PGWP expires so that is not an issue. But for the record I don't think you can get implied status for WORKING with a PGWP as they aren't extendable. There are long, multi-page discussions on this on this forum and others, and the consensus is, no implied working status.

Having said that, if you have a work permit good till '17, apply OUTLAND and you have a good chance of getting your full PR before it expires.

2) I would wait for the marriage certificate, then you don't have to prove common-law status. If there is a very long wait for your certificate, I think you can apply without it, and send it later (just show other proof of the marriage, and include a note explaining you are waiting on it).
