Help me changing nonsense law that punishes innocent people!
You probably know that... You go to school or have a job and pay taxes. Then one day you need to leave this country.. For a day, week or a month. Family emergency, vacation or just a shopping trip. All you need is a passport, right... Well not for everyone. If you are in "implied status" it is a different story. Even though you obey the law and pay taxes the government treats you like a criminal. You cannot leave the country. If you do you lose your status. And that means that you cannot continue studying, your work permit is no longer valid, you lose your health plan.They might not let you back in Canada. Besides tearing families apart it also has serious consequences for inland spousal sponsorship.
I brought up that nonsense to attention of my MP Bernard Trottier in August and we are supposed to follow up in October. I also contacted the Citizenship and Immigration minister Chris Alexander. No response yet...
My goal is to collect at least a couple of hundreds signatures to strengthen my voice when I follow up with with my MP and the government, or even with the media - in case the first route leads nowhere.
It is time to change this nonsense law!

I'm sorry to hear the frustration (and angst) regarding your situation, but unless you are legally eligible to vote in Canada, your signature on this [or any] petition will have basically no impact.

If you want people to sign your petition, make sure they are Canadian citizens.

Sorry to hear you are going through this. A few suggestions:

1. the gov't is not "punishing" anyone, you may want to amend the title to actually state what it is you want to accomplish.

2. Implied status came about to solve another problem i.e. to enable people to continue working, studying or visiting under the same conditions while awaiting a decision on their application for an extension(renewal). This is pretty accomodating if you ask me, and I'm not sure what better alternative there is.

3. no one is "forced" to remain in Canada. People make a choice to remain under conditions of implied status or leave and take their chances.

4. you may want to do research on other countries to find out what they do and if there is a better alternative to implied status; then include it in your petition with references. A country can not be expected to allow non-citizens and non-permanent residents to leave and re-enter without actual legal status.

5. you may want to look at whether implied status could still be a viable option if processing times are improved? This way an applicant isn't having to wait almost a year for first stage approval(inland sponsorship) with the risk of CBSA possibly asking them to leave Canada or be deported.

6. Implied status has it benefits too and I suspect the gov't would be pointing these out. The inland sponsorship is the only avenue where an applicant can be out of status, still submit an immigration application and wait for the decision in Canada. This is not possible with the outland route or any other economic stream(CEC, skilled worker, provincial nominee, etc).

Personally, I don't think one needs to be a citizen to effect change. So don't be discouraged. You will become a citizen someday anyway.

How many other countries have any concept of "implied status" at all? The Canadian Government could decide to completely remove it and simply say that you must possess a valid status at all times..
 
Well that's the downside to applying inland, I'm sure you've read up on that before you applied inland, no?

Otherwise you should've applied outland, where you can leave and enter as you please.

Agreed.

Many without status have also been allowed to remain in Canada while awaiting AIP.

Not only that, they are even able to apply for PR sponsorship without any status at all. Talk about being generous. It could have been worst, out of status, oh well, you must leave Canada or be deported before you can be sponsored for PR "outland".
