Hi all,
It seems quite difficult to get a definitive answer online. I am currently waiting for my spousal sponsorship to be assessed. My application was submitted January 31st 2019. aswell as my sponsorship my immigration lawyers submitted a temporary work permit under the pilot program.
Below is an explanation from my lawyer.
" To confirm, since we are including an application for a work permit with the spousal sponsorship, you will be able to continue working in Canada until a decision is made on the work permit application and so long as you remain in Canada. This is known as implied status.
The pilot project enables you to receive the work permit after 4 months of submission. You should also receive an email from Immigration when they have deemed the application as complete. The email is called an Acknowledgement of Receipt (AOR) email.
We also discussed that there is a possibility that the package may be returned to our office as incomplete (not rejected) and we would help you re-submit. However, if this occurs, you will never have had implied status since the application was deemed incomplete. If this occurs, you must apply to restore your status in Canada. This may only be done within 90-days of expiry of your status. If the package is returned and you are outside the 90-day restoration period, you will be unable to correct your status.
So, I have advised if there is no formal AOR email regarding the sponsorship package or work permit issued within 90 days to apply to restore your status as a Visitor as a precaution before the 90-days completes. This way, if the package is returned, then you have already taken steps to restore your status within the 90-day time period. A reminder, this is only back-up and not mandatory. We also do not expect your package to be returned. We only advise this as a precaution."
I may be jumping the gun but I am concerned as I have not recieved a AOR email yet and what I need to do if I do not receive it before the 90 days have come and go. Anyone with and advice or personal experience I'd greatly appreciate any help. My may concern is I'd like to book a trip to Cuba in July/September (6/7 months after the application was submitted.
