Hi everyone, I have to take a decision related to my work permit and I would really appreciate if you could help me with your experience and information.

I am a Spanish citizen under a 1 year working holiday visa, expiring in 1 month. By that time I will have 9 months of professional working experience in Canada, so I still won´t have points enough for the Express Entry.

I have the option of applying for the Young Professional, but I have to wait 3 months to be eligible. My current employer told me that they can support me with the application as long as they have vacancies by the time I can apply.

I had on mind to leave the country once my WHV expires and wait until January for my employer´s answer but since 2 friends in the same situation applied for the implied status, now I don´t know what to do.

They applied for implied status in order to complete during those 'extra months' the one year experience in Canada, and after that applying for the Express entry. In fact, one of them has already received an invitation from the pool.

Anyone knows if that work experience will be counted as legal for the Express Entry application?
Since there is nothing sure, I don´t know if should I stay longer or leave and wait for a Young Professional application that may not happen.

I really appreciate any information you could provide me. Thank you!!

You can’t apply for implied status. You get implied status if you are waiting to hear about another application. PGWP doesn’t allow you to get implied status in many situations.

Thanks for your answer. So my friends that applied for it in order to complete their year of work experience, will get their application denied? that experience won´t count as valid?

There's no way to make this work.

To temporarily get implied status, you would have to apply for a work permit extension. However you don't qualify for one since your employer hasn't obtained an approved LMIA. So eventually that extension will be turned down as incomplete - which will result in you losing implied status. Also - all of the work experience you gained after the IEC expired will end up being as unclassified work experience which cannot be counted towards PR.

Only option is to apply to change your status to visitor before your IEC expires, stop working once your IEC expires, and then start again once the YP visa is approved.

Correct - the work experience after the IEC expired is classified as unauthorized work and cannot be counted towards PR.
