A couple I know had Canadian residence status and had a son born in Canada and then they, for personal reasons, went to live in some other country. Now when the wife and the child returned to Canada, her PR card was confiscated because of failing to meet the 3 out of 5 years residency requirement and have been told to appeal in 30 days. My question is that if for some reason she fails to get a successful appeal and has to leave. Will she be allowed to take her child with her or will the social services or immigration prevent her from taking a Canadian citizen out of the country?
 
Does the other parent know that the mother would be taking the child in and out of Canada?
 
Immigration Canada will not steal her child from her. If she has to leave, she can take the child with her. However, there are rules because of risk of parental abduction so if she wants to travel with the child, she should carry a letter from the other parent allowing her to do so. If the other parent is in Canada, they have shared custody and the other parent objects, she would have a problem but that's not because of immigration but because of custody issues.
 
The father doesn't reside in Canada either and he may also be facing the same issue later for not fulfilling the residency requirements.
