I am looking for advice regarding the following case:
I was living in Canada for one year but I had to leave since my work permit expired. Now, I'm back to Europe. I've met my girlfriend in Canada who is a Canadian citizen. She left with me to Europe so at the moment we're living together outside of Canada.
A while ago I created my account for the Express Entry Programm. I received my ITA with 448 points as a single applicant. Since my girlfriend is a Canadian citizen, she was not included in my application. Now, we are thinking about getting married since she's pregnant in the 3rd month and we would benefit from other advantages like savings of 3500€ in taxes and insurances before we move back to Canada.
Once we get married it would be possible for me to apply as a spouse as well, but we don't meet the financial requirements since my girlfriend is still studying and not working full time. So she won't be able to prove steady income to sponsor me. On the other hand we don't really want to go this way because the spousal sponsoring has a processing time of around 12 months, compared to just 6 months under the Express Entry Programme.
The problem that we have now is that if we get married, I would have to change my marrital status and answer questions about my spouse. Since my girlfriend didn't do an IELTS test my points would fall to 428 points. On the other hand it doesn't make sense to ask for an IELTS test for my girlfriend who is living in Canada for more than 8 years and who is studying full time since more than two full years. But the questionnaire is not very precise about situation like that. It is not asked for example which citizenship my spouse has.
In the end there is no need for me to add her in my application since she's a Canadian citizen already. So in case we get married, is there a way to say that I am married, but that my wife is not part of this application so that I don't have to answer the questions about her English proficiency etc.
What kind of possibilities do we have? Any suggestions in any other way?
