Hello,

I have an uncle who is interested in moving to Canada, or even just to visit but we haven’t had luck with visitor visas. I understand I cannot do a family sponsorship but i really would like to gain insight on how i can help him get here. He is in his late 20s and is struggling to live a stable life in Iraq. I was wondering if we should try a work visa considering he has a university degree. Any advice would help,

To get a work permit, he first needs to secure a job offer in Canada and his employer in Canada will need to obtain an approved LMIA (before your uncle can apply for the work permit). The LMIA process involves the employer advertising the job for at least one month first to prove no Canadian could be found for the rule (following the LMIA advertising requirements). The employer would then pay the $1K fee and submit the LMIA application. Processing is taking ballpark 4 months right now (can be less or can be more). Assuming the LMIA is approved, your uncle would then apply for a closed work permit tied to that specific employer. As part of the work permit application, your uncle will also need to show ties to his home country (work permit applications can be refused sometimes for insufficient ties to the home country and concerns the applicant just plans on remaining in Canada long term). The job your uncle plans to take in Canada must be somehow related to his past education / work experience.
