I hope that you are all doing well, I have many confusions once more while doing this Spousal Sponsorship i am on my last form IMM 5669. My story goes before I ask the question:
This happened in the UK.
"Back in 2008 me and my now ex boyfriend, had a house together and in May 2008 I found out that was cheating on me and well story short it was with my then best friend, and our braking up was severe, he was physical strangled me and I pushed away causing him to have a scratch on his forehead, I was scared, confused and just remembering that moment it angers and saddens me, the police was called and they decided to take me away to 'calm the situation' while there, I was told that I would get a 'caution for ABH (actual body harm) just for a scratch
at the time I was so broken and I didn't want to deal with anything more and of course I did not know I would meet my now wonderful and amazing husband (Mr Canada) that I accepted the caution. I was NOT charged after that i has been almost 9 years since that happened and it appears in my police check as a 'Live No Trace' because it holds no further importance/ no longer relevant."
I want to state the reasoning and I have written a detailed page about the situation (yet again having to bring a very painful past to have my future with my husband) My confusion lies which of this should I tick.
a) been convicted of a crime or offence in Canada for which a pardon has not been granted under the Criminal Records Act of Canada? I have said 'NO' to this as it did not happen in Canada.
b) been convicted of, or are you currently charged with, on trial for, or party to a crime or offence, or subject of any criminal proceedings in any other country? I want to say NO, because I was not convicted nor charged - but perpetually confused'
j) been detained, incarcerated or put in jail? BASIC 'grey area' for me. Yes I was taken in to 'cool off' and so did he, right after me according to my ex, he was mad he was taken in. Even though it was a couple of hours. I assume that I tick 'YES' ? Confused....
I hope that someone can shed a light into my utter confusion as I don't want to be in the frame of 'Misinterpretation' It is in my past and I can't help it and I don't mind having to open my haul of painful memories just so that I can be with my husband, so I want to be as honest and correct as I can to help our chances to be in Canada together and start our family.
