IMM5409 needed or not?

Hey guys,

I have a question about form IMM5409.

I’m applying for PR through the Quebec Experience program (Got my CSQ after completing my PhD). My boyfriend is a Canadian citizen. Do I need to fill the Declaration of Common-Law Union? He is not sponsoring me. I'm in Canada on a work permit currently.

My two cents is that I don't need this form as this is what is written in Guide Q7000 - Application for Permanent Residence: Quebec Skilled Worker Class:
Statutory Declaration of Common-Law Union (IMM 5409)
Who must complete this form?
This form must be completed and signed by the sponsor and common-law partner, only if the latter is a co-signer on the application

I'd like a (couple of) second opinion(s) though.

And this is what it reads on the checklist:
If you have a common-law partner, complete and include Statutory Declaration of common-law union (IMM 5409 - original) and provide evidence (...)
Now I'm confused...
??? ???

I called to CIC and agent told to fill it up, another agent told not to fill it up, but my lawyer told me that I shouldn't fill up because it doesn't make any sense.
If you partner is Canadian and you got your own CSQ (and only you got it), it's no point to fill up IMM5409.
