IMM0008_1e Point 9 - been refused ... temporary resident visa to ... any other

Friends,

I am filling form IMM0008_1e, as i applied for H-1B is year 2006/07 and it was refused, I am giving this reason for the same:

Please suggest if it is fine:

I applied for H-1B Visa in year 2006/07, it was refused under section 221 (g) of the Immigration and Nationality Act with following reason sent in letter via postal mail:

Your petitioner does not appear to be either
able or willing to provide qualifying employment in the United States in accordance with appropriate law and regulations.

(Copy of letter attached)

Thanks lot for your comment, Yes i have just written very brief what I can add in it in addition can be "The company I applied H-1B with was a new company, they didn't have Tax Info and other documents like Projet Details etc so I was give 221(g) at the time of Visa Interview at US Consulate New Delhi, after providing some of the documents listed as required in 221g I received the letter of refusal containing the reason"

above is the actual reason and saying due to 221g is same in the immigration language.

Please also suggest me should i write the same of Company I applied with, or it is not required?

Hi Pankaj,

If fact there is no big deal on this matter. It appears that you are a straight forward person. So just the brief note what you want to put is enough. Don't worry on this point. Take it easy!!.

Hi Pankaj,

I would say 'yes' to your following point point as it is only 2 months job and no need to provide too much back up.

My Question is what should i do about the reference:

1. As it is other NOC Code and simply 2 months job period, should i simply send the notarized copies of appointment letter and experience letter i have

Pankajk I do not think so that you need to give name of company. Your explaination looks good enough and explains everything
