I’m currently on open WP currently working for an employer( Company A) in Canada in NOC B job and opened up my profile. Since I didn’t meet the CRS score, I got an LMIA from a different employer ( Company B). Can I use this LMIA to claim 50 points, while working for company A on PGWP? I don’t have plans to leave my current job and start working for the employer who gave an LMIA for me.

It is generally not possible to use an LMIA (Labour Market Impact Assessment) from one employer to claim points under the Federal Skilled Worker Program while working for a different employer on a Post-Graduation Work Permit (PGWP). The LMIA is a document issued by Employment and Social Development Canada (ESDC) that assesses the impact that hiring a foreign worker would have on the Canadian labor market. It is generally required for employers to hire a foreign worker on a temporary basis, and it is specific to the job being offered by that employer.

If you are working for a different employer on a PGWP and you want to apply for permanent residence under the Federal Skilled Worker Program, you would need to submit a new application and meet all of the program's eligibility requirements, including obtaining a new LMIA if one is required. It is important to note that the Federal Skilled Worker Program is a points-based system, and obtaining an LMIA is just one way to earn points. There are other factors that are taken into consideration when determining your eligibility, such as your education, work experience, language skills, and adaptability.

It is also important to note that you must adhere to the terms and conditions of your PGWP while you are working in Canada. This includes working for the employer specified on your PGWP and not engaging in any unauthorized employment. If you violate the terms of your PGWP, you may be subject to deportation and may be ineligible for future immigration to Canada.

I hope this information is helpful.
