illegal status in Canada from an expired Working Visa from Australia,please help

Hi,
I was wondering if anyone was able to give me any advise on a troubling issue. My brother left Australia for Canada in Jan 05 with A 12mnth Canadian Working Visa from the Australian Government in legallity with Canadian Law. He worked in Canada with this visa for the duration of the year and then remined in Canada for the 3month "holiday" leway after the 12months of working was up, thus being in canada legally for 15months. During this time my brother met a Canadian girl who just prior to his working visa expiring was involved in a very serious car accident, leaving her fighting for her life and a very lenghty recovery process, in which her accident has left her with a traumatic brain injury. My brothers first reaction was to remain by her side to support her, thus without even realizing his visa expired during this time. Since this inncident he has remained in Canada because he is petrified that if he leaves the country or gets "found out" then he will not be able to re enter and lookk after his girlfriend. During the time since his visa has expired he has not been working, volunteering for lots of youth charities, but is being souly supported by his Australia family off shore. He is extremley gifted businessman and artist but has not worked since his illegal status has come into play..... what grounds does he have to apply for any temporary residency, visas or status. He would be able to obtain another Australian Canadian working Visa due to changes in our laws, but has to ''enter to canada" to activate... but he hasnt left!!

I would suggest you bring this up again and request in the title if PMM could assist you. What a tragic situation, but I have doubts that CIC will cut him any slack since it was so long ago, and he could have gone directly to an immigration lawyer once he had dealt with his girlfriend's situation and explained to them then what had happened and ask what to do going forward. He would not have gotten deported right then if it was bad news, and could have dealt with it properly in order to stay on. It's now been several years, and CIC are heartless drones so I don't know what will happen. It's too bad, it sounds like he would be a great addition to Canada. I wish him all the best.
