Hello all,

I'm principal applicant with my dependant child. My spouse is not accompanying with me because of the personnal problem. But he is also required to undergo the medical examination.
I want to know it would be influenced on my application if the health of my spouse is not met to medical requirements???

If you want PR without including him, you will need to be divorced.

You can file your app while separated and showing proof that you've filed for divorce, though CIC will expect to see the divorce finalized before approving your app.

Yes i think i'll do it, but I really don't understand Why the medical problem of one family member non accompanying has influence on other members in the application???

Because it becomes a backdoor into a "Family Class" Excessive Demand Exemption if they are not checked during the initial application. Therefore it is enforced "enthusiastically" by CIC.

As zardoz said, it closes a backdoor. The Excessive Demand Threshold prevents people with costly medical conditions from immigrating to Canada. Say you include your spouse in your app but he is declared medically inadmissible to Canada because of an expensive condition. If CIC still approved you, then you become a PR. You could then sponsor your husband under the Family Class, which is exempt from the Excessive Demand Threshold. CIC prevents loophole this by refusing the entire family if one person is medically inadmissible.
