I have abandoned my refugee claim in 2006 and never left Canada.
4 years after i got in love and married my now wife and we have a beautiful kid
and have been leaving together since.

now she wants to sponsor me... and we are trying to do it outland
but i'm a little scare that they might never let me come back and be with my family :-[

what should i do??

Not sure outland is your best option. You can try exploring the inland route. Your case is beyond the knowledge of many of us here. Contacting an immigration lawyer may be your first step. Money is a big deal but you need to spend some to make things right from the get-go.

You need to submit a strong application in support of your spousal sponsorship. You must gather all the evidence of the development of your relationship and its continuation from inception to present.

You also need to consider leaving Canada voluntarily. With the abandoned refugee claim, you were under a departure order that probably became a deportation order, and with that hanging over your head, it will be very difficult to get PR status, but not impossible.

we are trying the outland application because
according to an immigration consultant they can still get kick me out if they want to with the inland.

and we have very good proofs from pictures on our wedding ceremony with both of our families
from our baby's birth first pictures. and that we have been together for the past years with good recommendation letters
from social workers doctors and lots of people that they can say our marriage is legitimate.
our lease for our apartment and from that part im not so concern.

my concern is if they are going to punish me for overstaying and for dropping my case

Like Charlie said, leave voluntarily and it'll look better. You can leave for a day, a week, a month and try to come back and hopefully you'll be allowed back in. But yes, you do need to leave VOLUNTARILY, then they will see that you tried to make amends instead of waiting for them to come find you and essentially kick you out.

Best thing to do in your case is see a good lawyer. Just pay a consultation fee at least to get some good advice. May be you can try out family lawyers toronto. There are free immigration consulation service for low income families.

Good luck.
