I have a pending charge, am i eligible to immigrate to canada?

Hi everyone, my name is Paolo and I'm from Italy. I'm going to explain you briefly my situation. I have a pending charge for Obscene Acts in public place, police caught having sex in my car. Last year I tried to apply for the Working holiday visa, but my application was refused probably for my pending charge but actually I haven't received yet the letter of explanation. Anyway, i decided to come to Canada in any case last summer as a tourist and I found a company whi decided to sponsor me, but they unfortunately they didn't get the Labour Market Opinion because tehy received to many applications from canadian citizens or permanent residents. However, this year I'm going to apply again for the working Holiday visa and I will attach also the job offer letter from my employer, do you think that I have any chace to obtain this kind of permit. Consider that more than 4 years are passed from the crime.

Are the charges still pending? If so, then I think you can expect the working holiday visa to be refused again.

yes, my charge is still pending, but my lawyer said that usually is better to have a pending charge than having a conviction. I was checking for rehabilitation, but I've seen that I have to wait at least five years after being convicted.
