Hello,

Background: I am a Canadian citizen and so is every member in my family and I got married to my boyfriend of three years (he has an Indian Citizenship) exactly one month ago. I graduated from college in April 2018 and immediately got myself enrolled at University for another degree (4 year program). I am a full time student, and I have never worked at a real job although I volunteer a lot. I don't have a permanent job, and I don't work anywhere currently. Because I have lived in Canada all my life, moving to India is a huge cultural shock for me, so my husband decided to come to Canada instead, so he filed for a PR exactly 1 year before our marriage (which was last year) but his application is still in the express entry pool. We have lived apart a long time and I really want him to be here with me.

My question
: Can I, a full time Canadian student sponsor my husband for either a PR or a work Visa, so that he can come and live with me in Canada? If yes, what are the procedures for him to come to me as soon as possible. I would greatly appreciate a prompt reply.

You cannot sponsor you husband for ONLY a work visa.

You can sponsor your husband for PR. It will take roughly a year for the application (for most cases).

How did you support yourself without working? How do you plan to support your husband after he becomes a PR?
Do you have savings? Do you have support from your family in Canada? (e.g. financial help, free place to stay until he finds a job...etc)
 
I belong to a traditional Indian family and we all live together, so basically I live with my parents, grandparents and siblings all under the same roof (I know, crazy right?). Also, in my culture we believe that the greatest gift parents can give to their children is education. Basically, I live with my parents without paying them rent, and they have gifted me education so I don't need to pay for fees.
My husband is a computer engineer and gets paid really well in India, so if he can come to Canada by PR or work visa, he would be the bread winner by either applying for an internal transfer from his current workplace in India to Canada, or he would come here and find a job. After my education gets over, I will work too. Till then, I have no means to support him. He can either live with me and my parents or he would rent an apartment of his own and I could live with him.

There's really zero chance of just getting a work visa. He needs to start by applying for a TRV (tourist visa). If that's approved, then he can come to Canada and you can sponsor him for PR inland - and include an open work permit with the application which would be approved after around 4 months. If the TRV is not approved (and there's a significant chance it won't be), you will have to sponsor him for PR from outside of Canada and he won't be able to come to Canada until the PR application is approved. Processing will likely take a year.
 
Does he have savings in addition to your potential family financial support?

Yes, he has been saving for about 2 years so he can potentially rent his own apartment while looking for a job and he would be fine. He has his own savings, and financial support from my parents here in Canada, as well as from his own parents in India.

Think we are all aware of the south East Asian tradition of living in a multi-generational home. Many people have built these mega homes right up to the property lines in Toronto. You are quite lucky because it's pretty unheard of for the son to live with the wife's parents especially if he is the eldest son. Even though your parents support you (education, food, housing) you must show that you can care for yourselves as a married couple with some help from your parents. There have definitely been situation where families clash when living with their parents once they get married. Your parents will have to provide their financial information and submit a letter agreeing to not charge you both rent and help you financially if needed. Your husband can also submit his financial information as well as indicate that he is a computer engineer and explain that his skills are needed and he should be able to find a job quite easily based on the contacts he has already made (assume that is the case).
