If I was refused (currently applying outland, spouse sponsorship) could I lodge an inland application rather than go through the appeal process? And could I do it immediately?

Yes.

You may only have one application in the same class at a time, but once you have a refusal to one application, you can file a second application.

Why do you think you'd be granted approval on an inland application if you were refused on an outland application? If the outland office deemed it an MOC, it is likely the inland office would do the same thing. If you have some other issue (inadmissibility) the issue will be raised on the inland application as well.

Thus, the real question is "why do you think you'd be successful on an inland application when you had previously been refused on an outland application?"

Could just be they are overly pessimistic about the whole process and are expecting the worst. You could give 2 identical application packages to 2 different VOs... and have 1 approve it no problem but the other VO just not "feel" its a genuine relationship and end up in rejection. Lots of this process comes down to the personality and feelings of the particular VO assigned to your file.

Another question to ask is if you apply inland after being rejected outland... would the inland VO working on the file have full access to all the info from your outland app and all the outland VOs notes and reasons for refusal?

Absolutely. I've been through something similar (first application refused) and it is very clear from the GCMS notes that the first officer to review my file only hesitated from approving it because of the first refusal. A more senior officer reviewed it as well and indicates she or he had reviewed the previous rejection and concluded that it was not a basis for rejection of the second application.
 
Yep, just pessimistic!

I mean... If we filed an inland application, I could be here working while it was being processed, and if I got refused again it wouldn't matter so much because we would have time to save some money to move somewhere else.

Which could be gaming the system I suppose, so maybe that wouldn't be a such a good idea. I would be applying simply to buy some time with my husband, not move here.

But yes, I'm just very pessimistic right now, though I have no real reason to suspect we would be refused. The whole process is just driving me mad and I'm wondering about our plan B options if we do get refused.

I assume you're a UK citizen applying through London-RPC visa office? If so the approval rate is 94% for spouse/partner family class... so in most cases you don't need to worry.
 
Thanks, Rob. That is reassuring!

It's just that since joining this forum it's come to my attention that our application was on the skimpy side. Just a few photos and our official documentation (marriage certificate etc.) Obviously if the VO needs more they will ask for it (adding even more time to the wait :( ) but I'm a worrier by nature and like to know where all the "escape routes" are :p I'd drive myself crazy (crazier?) if I didn't spend a good portion of my time figuring out exactly what we'd do in any given situation.

Don't be pessimistic, you have no reason for it! :-) you're married, you're from a visa-exempt country, and you have a "normal straightforward case", no reason why you won't be approved.... if the VO needs more he will ask for it, but most likely they will just see that it's all good, approve the PR, and that's it! my application was not that big either - around 10 to 15 pictures at most, and papers to prove the common-law part as we're not married. Got approved in 4 months in London, most likely it'll be the same for you!
Think about it that way: it's "WHEN" you are approved, not "IF" you are approved!

Ya i concur. We had less than 20 photos and just a couple other supporting documents to prove common-law, only 1 letter from a family member, and no "relationship essay" that many people include. Entire app was super thin at the end. Yet we took 4 months flat from submitting the app to getting COPR in the mail. If you are confident in your own relationship and its all pretty straightforward, you should be optimistic instead of the opposite!
 
Oh gosh the relationship essay! I go from laughing to crying about that one after reading through the forum and seeing people writing 8-10 pages about their relationships.

We wrote like, 3 lines. Not pages or paragraphs. Lines.

LOL

Oh well. I freak myself out sometimes but when I think about it I realize there's not much point in it. You guys have definitely cheered me up! Thanks :)
