Please i need someone to answer this,
1) what if the sponsor is ineligible to sponsor under family class because of criminal case bodily harm 2012 and the sponsor is canadian,can we apply for humanitarian and compassionate but my working permit ends this december 17 and we have a 5 mos old baby.
2) if we apply for H&S can i stay here in canada while waiting for the decision even if im out of status? Because i read that it takes forever to make cic decision

As mentioned in your other posts, you (or your sponsor, if you are the applicant) have a big problem.

With all due respect to the applicant, why should a sponsor that inflicted bodily harm on the family member be entitled to a H&C application?

What's humane or compassionate about someone that would do that?

If you are in Canada without status, you have an even bigger problem.
 
Thanks for the reply pongga, thats why im asking if he is not eligible should i or myself can apply for H&S since we have a baby, and if im going to do that (applying for H&S) while having status like what i said till dec 17 do i have a chance to stay here while waiting for the decision just confused and very sad because if theres no other way i dont know what to do next and i want us to be together as a family not just because i want to stay here and earn money :(

Just apply for H&C - is NOT give you status and NOT allow you to stay in Canada, except if you receive "First Stage Approval" or AIP (Now its takes approx 3-12 months to wait) and unfortunately only 10% cases get approved.

H&C is grounds apply to people with exceptional cases and you have to prove it. Extremely hard to prove
