My husband's PR card has already expired last year. It's been over a year since he applied for renewal. Unfortunately, my husband did not meet the residency obligation (730 days) and we think it may be why the renewal of his PR card is taking so long :( He still has his expired PR card on hand.

My husband is planning to visit me in the Philippines for 3 weeks. Of course, he is planning to apply for a PR Travel Document when he gets here.

But since he was not able to fulfill the RO (730days), I've read that he might have a hard time applying for a PR travel document.

So the problem is HOW CAN HE RE-ENTER CANADA?

I've read in this forum before that those with expired PR cards can still return to Canada by riding a private vehicle from the USA. This is an option we're looking into.

So his plan is to book a flight from the Philippines to the US then cross the border to Canada via private vehicle (a relative will pick him up). Has anybody tried this before?

Questions:
1. Will this work? Will he be able to return to Canada?
2. Since he was already not able to fulfill the residency obligation (730 days), will leaving Canada affect his pending PR card renewal?

It appears that it would be foolish for him to leave Canada at this stage. Better to be certain he is in compliance with the PR Residency Obligation before leaving Canada again. Not by a few days, but clearly in compliance. Probably best to wait for a new PR card.

Yes, he can return to Canada. But he is risking being reported for inadmissibility at the PoE. The PoE officers will identify him as a PR. Even if there is no alert in his FOSS (given the secondary review of his application for a new card), there is a substantial prospect they will identify him as a PR who should be examined for compliance with the PR RO. He must be allowed to enter Canada. But if he is reported for being in breach of the PR RO, that will result in a Removal Order. He can appeal that and stay in Canada during the appeal. But if he loses the appeal, he loses PR status.

Yes, many have done what you describe in the PAST. The extent to which PRs in breach of the PR RO can get away with this is clearly on the decline. More are being screened and reported. The lack of a currently valid PR card now tends to trigger the increased scrutiny.

Simply better to not leave Canada until he is solidly in the clear with the PR Residency Obligation.
 
What happens when you do not meet the residency obligation? My husband applied for renewal of his PR card on March 2015 and until now his application is still in process. It's been 1 year and 1 month already.

Does renewal usually take this long when the PR does not meet the RO (730 days)? How long does it usually take? :(
