Hi everyone,

I am seeking advice regarding a potential issue with the Atlantic Immigration Pilot (AIP) program and the New Brunswick Provincial Nominee Program (NBPNP). My husband recently received a job offer as a scientist in the chemistry field at the University of New Brunswick, with a contract duration of one year. We were hoping to apply for permanent residency under the AIP program, but I have checked the list of designated employers and the University of New Brunswick is not listed.

We have also looked into the NBPNP, but they require a permanent job offer, while my husband's position is based on project funds and his contract is renewed on that basis. We are unsure of what our options are at this point and would greatly appreciate any guidance or advice that you may have.

Investigate how many points you'll have under Express Entry / Canadian Experience Class after a year of working in Canada. If you have enough points, this may be an option (FSW may be an option if you have enough points right now without Canadian work experience). Do not include the 50 points for having a job offer. What your husband has does not qualify as a job offer under EE.

I'm confused about the points required for the Federal Skilled Worker (FSW) program. As per the official website, the minimum points required for the FSW program is 67. However, you mentioned that there is a 50 point requirement for a job offer, and you confirm that it does not qualify as a job offer under the Express Entry (EE) program ?
academic job offers can be accepted for the Express Entry program if:
1. The job offer must be from a Canadian employer that is recognized as a Designated Learning Institution (DLI) = it's from University "DLI"
2. Academics, including researchers are exempt from the LMIA

You'll need to read through the info on the IRCC site in detail. No shortcut to this, apart from hiring an immigration lawyer to do this work for you.

The 67 points is the minimum you need to score under the FSW point system to qualify.

You then have to assess how many CRS points you have. This is a different scoring system. This scoring system is what the draw is based on. Basically those with the most points are selected.

So first you need to determine if you have at least 67 points under the FSW system. Then you need to calculate your CRS points.

In order to claim points for having a job offer, your husband would have to work for his employer first for a year in Canada (this is because he is on an LMIA exempt work permit). Additionally, his job offer would need to have no end date and his employer would need to provide a letter stating that they will continue to employ him for at least a year after he gets PR. Since he's on contract, he doesn't meet the requirement and can't claim points for having a job offer. He doesn't need a job offer to qualify and apply, but it definitely helps when it comes to scoring points.
 
Sorry for the delayed reply, and thank you for all of this information. I have contacted them about this matter, and now NBPNP NB Skilled Worker Stream has been updated to remove the requirement for a permanent job offer.
We are considering applying for either the NB Express Entry Stream or the NB Skilled Worker Stream. What do you think would be the best option for us? Thank you.
