Hi..My spouse has a Canadian job offer but the employer is not supporting with the LMIA.Our consultant has told that we cannot apply even for Ontario PNP without LMIA.Can someone tell me the process on how to get LOI from Ontario?

Without an LMIA, you would need to be selected through Express Entry.

How many points do you have under Express Entry and what is the primary NOC?

We have already created an express entry profile but I am the primary applicant. His profile is not created yet as his WES is pending. Currently our score is 438 which is not inclusive of his Wes and ielts score.
NOC code of my spouse would be 2171.

Your spouse has to be the primary applicant if job offer with LMIA is included. What is your NOC. 438 is too low for EE-FSW and Ontario (don’t know if you are eligible for OINP anyways).

Is this with or without the 50 job offer points?

Note that you cannot count the 50 job offer points unless you get an approved LMIA with the employer.

Once we create a profile on my spouses name, the points would be reduced even more since he has only bachelor's and age is more than 29. Score would be somewhere around 302 which is even less.
Can you please tell if it is really important to have LMIA for OINP LOI too?

Your spouse can apply under the foreign worker stream which is not through EE. The employer and job offer must meet specific requirements.

So you need the LMIA. There is no other option for OINP unless your spouse is the primary applicant with a score of 450+. You can’t be the primary applicant for OINP but can be for Express Entry.

Sorry for OINP, if you want a nomination your spouse must be the primary applicant for the EE profile.
