Do I need to provide a police certificate when applying for permanent residence?
Yes.

How and where do I obtain one?
Applicants located in Somali land or Punti land should apply to the local police authority.


So let me explain, now Somalia is divided into 3 zones, Somali land , they declared independence from Somalia in 1991 and they have their own government, while Punt land is a autonomous state of Somalia, while the 3rd is the southern Somalia where the official Somali government controls a limited areas, while the rest is occupied by anti government forces.

Somali land administration is well run and very strong and PCC can be get easily, while Punti land such paperwork does not exist and mentioned no one ever asked them, i even asked them if they can provide a letter expalining that they can not provide a Police certificate and they said, we can not, therefore

  • is there a way I can prove to CIC that i was unable to get the PCC?
  • Do you guys think the Somali land PCC will be sufficient based on CIC requirement above?

Unavailable. There is no competent civil authority in Somalia. The Government of Somalia ceased to exist in December of 1990. Since that time the country has undergone a destructive and brutal civil war, in the course of which most records were destroyed. Those few records not destroyed are in the hands of private individuals or are otherwise not retrievable. There are no police records, birth certificates, school records etc., available from Somalia. There are no circumstances under which immigrant visa applicants can reasonably be expected to recover original documents held by the former Government of Somalia.
 
Have you reached out to the Somalian embassy / consulate in Canada for help? Have you contacted the Canadian embassy / consulate in Somalia (or responsible for Somalia) for help? Do you have emails from them confirming what you're doing isn't possible?

My husband was in a similar situation (but for a different country). We provided extensive evidence (printed emails) to show all of the people we had contacted for assistance and their answers back to us. We also printed information off web sites that said it was impossible to obtian a PCC for that country and time period.

What must I do if I cannot get a police certificate for my application?

You must send two documents with your application:

a written explanation; and
an original letter from the police confirming they will not issue a certificate.

I had the same - could not get 2 different PCCs. I printed all the emails I had showing that I really tried, and explained in a separate letter what I did, and my PR was issued, so it's possible.

Thanks everyeone for your replies.

The problem of getting emails from them , is that they don't have government domains, they may send it from a hotmail or a gmail.

that's probably OK... I never got a direct answer from an embassy... I only explained what I have tried, and also printed emails from a friend of mine who was trying (because still in the country) to get the PCC on my behalf. He was explaining what he tried etc, and I could show the different attempts he made, over the course of a few months, and they accepted it.
I'm sure CIC is used to applicants from Somalia encountering this type of problem.

Somalia don't have an embassy in Canada, but it is covered by Permanent Mission of the Somali Republic to the United Nations in New York,
I will try to contact them and ask if they can provide me with a letter confirming that such PCC is not available in that area,
at least the embassy have a un.org domain

Sakamath, the CIC link is very usefull i will try to make those two letters , also about the other link, it seems US and Australia are more aware of the Police certifications of Somalia, i will try to attach that explanation of the US and Australian goverment.

My wife is from Burma and she's been living abroad since she was 19. On CIC website it states that Burmese PCC cannot be obtained if the person is not living there any more so we'll just write a letter of exp. They also provide the template of the LoE.

I'm wondering how CIC will deal this kind of circumstance? Is our case gonna get delayed because CIC have to do the criminal check for my wife by themselves?
