As you may know, since October 20th of this year (I think) new international students and spouse can travel together without written authorization from IRCC, as long as the spouse demonstrates that his/her travel is not optional, like for example, when the spouse is helping the student to establish in the country... but my question is... how can I demonstrate this?

My husband is traveling with me, and he is going to bring a temporary work permit from his job, which says that he needs to return in up to 6 months to continue the project he is working on, but, is this enough? is it even valid?. We are also thinking about buying the returning flight ticket, but, we don't know how long will be allowed to stay in the country if he passes.

There is not much information about it. Does somebody have any information that could help us?

Thank you!!

If your husband is traveling on a TRV, then he should have a return flight. Since months seems like an extremely long time for him to Canada if the purpose of his travel is to help you establish yourself here.

Ok, but what time would be appropriate? because they say a minimum of 15 days, but they don't mention a maximum number of days.

Don't think anyone is going to believe a letter saying your husband is going to have to return within 6 months to finish his project. Most spouses accompanying international students don't seem to be having many issues entering but an OWP would be better than a TRV. Have you applied for his OWP? Is your husband planning on working remotely? Does his employer have any offices or customers in Canada?

An OPW won't work because spouses can not pass if they do not have a valid job offer already. My husband is accompanying me to help me establish myself in the country. He works by project, so he asked to be suspended until he returns, so I don't know if it's hard to believe but is the kind of work he has. Also, border officers can call the company to confirm this information, with no problems at all, he will have his job back once he returns. Of course, I would like him to be with me as long as possible, but that is why we don't know how much time would be ok to ask border officers, and we don't know to which date we should buy the return tickets =S.

Hi
Did you travelled to Canada already? If not, when are you planning?
I am in a exact same situation and planning to travel on February 20th.
I am an international student, traveling with my husband who has a valid visitor visa.

Please update me.

Thanks.

Yes!!, I am already in Canada. Unfortunately, my husband did not come with me, because the rules have changed. Now canada.ca states that a familiar member can help you to establish only if you are a minor child or if you have a disability. If your spouse is coming with you, must have the OWP and the job offer.

Ohh really!? Are you sure about it. Because we have already made plans and booked flight tickets. Is there any other way my husband would be allowed? Do you know any email or contact where I can call and confirm?

Yes, I checked the web page yesterday; you can review this information here: https://www.canada.ca/en/immigration-refugees-citizenship/services/coronavirus-covid19/students.html under the header:

If immediate family members want to be with you in Canada
If they want to help you get settled in Canada

Also, you can review the restriction about the work offer under the section:

If they’ll study or work in Canada with you

You click on the workers' link, leading you to travel restrictions for temporary workers.
It doesn't matter if your husband has an OWP. He needs the job offer and to ask for a written authorization to enter Canada.

My husband required this written authorization without the job offer, and he received the following:

Subject: Request to be exempt from Canada’s Travel Restrictions for the Purpose of Family Reunification

January 13, 2021

Good day,

Your request to be exempt from the current restrictions to travel to Canada has been refused under the Order in Council, Minimizing the Risk of Exposure to COVID-19 in Canada Order (Prohibition of Entry into Canada from any country other than the United States).

Based on our assessment of the information you provided and the information in our system, we have not found that you meet the immediate family member exemption. In particular,

· you have not established that your reasons for travelling are non-discretionary or non-optional.

Please note that if you already possess a valid visitor visa (TRV) or electronic travel authorization (eTA), this refusal has no impact on your travel document, and is solely a refusal of your request for written authorization which you require to travel to Canada while the travel restrictions are in place. If you do not already have a valid TRV or eTA and have applied for a travel document, this refusal for written authorization does not have an impact on the processing or on the decision rendered on your TRV or eTA application.

As you are not exempt from the restrictions to travel to Canada, you should not plan or undertake any travel to Canada, as you may be prevented from boarding your flight and/or entering Canada.

Sincerely,

Immigration, Refugees and Citizenship Canada NC17889

They took like 3.5 weeks to answer our request. So by now, I think you should look for a job offer first before making any plans.
In addition, now it is mandatory to deliver a covid test result to get on the plane, so be careful about that.
