I have applied as a bookkeeper which is now not in the list on 12th july 2008 through a consultant from Delhi ( India) . When i have applied at that time i was also performing 80% of job duties of Accountant which fall under the list of 38 but at that time my consulatant advice me to apply as a bookeeper as i was only B.com Pass from delhi university . He told me that you dont have any professional qualification like Chartered Accountant/ Certified General Accountant/ Certified management accontant etc so your case may be rejected as an accountant. At that time 38 list of occupation not came but the announcement was made on 28th feb 08 that new list of occupation will come soon & the same has happened on 27th nov 08 new list of 38 came & my occupation of bookeeper was not in the list & so i got my rejection letter 5 days back.
Now I approached to some of the best consultant of Delhi one of which is ***** . I told them my all story that what happened with me morever i told that I am also performing the job duties of an accountant from last 5 year . Also i told that I am only B.com Pass & dont have any qualification (Chartered Accountant/ Certified General Accountant/ Certified management accontant )etc.
Then they suggest me that we can upgrade your case by reapplying as an accountant from sept 08 to till date & hence you can show the one year experince as an accountant & it will work.


Below mentioned is my detail of job profile which i have shown for about 10 year as a bookkeeper which has rejected


My age is 30 year
I am B.com Graduate
JOB PROFILE


 Calculation & preparation of cheques for salary, Vendor payment, &

other Bills .

 Reconciliation of banks, suppliers & customer account etc.

 Filing tax return to various tax authorities.

 Making all type of vouchers, Passing all type of entries ,preparing of Trial balance , maintaining of General ledger, Financial statement (manual , computerized).

 Submission of tax remittance forms, Employee Provident Fund, Employee State Insurance ,Employee Pension Fund& other Government Documents

 Making of balance sheet and profit & loss account, cash flow
Statement with an object to present to the management.

 Reporting to management for various financial / accounting & statistical

analysis



OTHER KNOWLEDGE

Tax deduction at source Return & Certificate

Working Knowledge in ESI & EPF

Now please suggest me that if i show one year of experience as an accountant then will it work my qualification of b.com pass will work for accountant where as i am performing all job duties of accountant

Wait for a year since the time you last applied and apply again. Dont change anything from your previous application just make sure you get a letter from your employer which states duties as listed in the CIC website for that one year( provided you have been actually doing them, dont do any false representation), When was the last time you applied?

I applied on july 2008 as i already mentioned that on that time i was performing 70-80% of accountant job duties but i applied as a bookeper as suggested by my consulatant from July 08 to dec 08 it is more than one year so i can refile my case as an accountant & can show my experience from sep08 to till date as an accountant & automatically it is one year experience . Morever my company will give me letter for my job duties as an accountant which i am doing .

Can you suggest me that what should i take from my company to make my case strong such as job responsibility letter , appraisal letter showing that they promoted me from bookeeper to accountant

I am not sure if accountant is part of the list.If it is then good.I suggest you show experience from Dec 2008 to Dec 2009. A few months gap is good. Don't be impatient this time, don't hurry too much , this way you will make some mistake or the other. I have been dealing with visa issues for a long time in my own case, have had to face rejection a few times, don't loose hope.

I am not the best person to talk about what documents to submit as I am not aware of the up to date information as of today but what advice I'll give you is make sure your documents are ABSOLUTELY clear and does not leave even 1% to the caseworkers imagination or judgement. Automatically assume that the caseworker is dumb as a doorknob and provide documents in such a way that even a doorknob would be convinced. There is no such thing a too many documents but make sure you don't send irrelevant stuff . One more thing make sure you are honest as this time they are bound to make checks as you are calming something different from what you had claimed earlier.

My second question is this that WWICs, YAxis & oasis these three consulatnt told me the 38 list is going to revise on 31st jan 2010 .So what will happen in my case if i file my case now in december & i get my file number after when the 38 list revised because i heard from the forum that file number will take 40-45 days . Can you answer my question that when they consider my case that it has applied from the date when i filed my paper in embassy or when i will get my file number because if they consider my case when the file number issued & i if i get my file number after 38 list revised then again i will be failed because no body knows that accountant occupation will fall in new list or not

See if you have already decided to spend money on a consultant then you should Contact David Cohen and take his review on that how much your case is doable. See CIC will already have a record of your file and once again if you file it, I do not know how will they react if its a different case. I would suggest contact them via email or something or call them or they can call you back.

I don't think there are going to be drastic changes to the list, Its always been the case that (even with UK HSMP or Tier1 or even for that matter the last changes to the Canada immigration) when the changes are made it actually becomes easier for genuine candidates and harder for fraudsters. So I still think you should not hurry things up, this could be your last chance. I know how anxious it can get but you are in a tricky situation you should ensure that you don't mess it up totally.

This is just my opinion, its up to you to take the final decision.
